Sentence: 26 years for Josue Estebanez

26 years for Josue Estebanez, found guilty of Madrid underground murder

The court considered ideological hate motivated the killing of an anti-fascist protestor
The soldier on trial for the murder of a young anti-fascist demonstrator at a Madrid metro station two years ago has been sentenced to 26 years in prison: 19 years for the fatal stabbing of Carlos Palomino and another 7 years for the attempted murder one of the friend who came to his aid attacking Josue.
While the accused, Josué Estébanez, denied that he was a neo-Nazi during his trial, the provincial court in Madrid considered, as the prosecutor had argued in the case, that ideological hate was behind his motives for the stabbing, giving him a lengthier sentence for the murder.
The reasons to consider this are:
a) His aesthetic of neonazi skin
b) The motto 'Sieg Heil', he shouted while he was cornered after stabbing Carlos Palomino, used during the III Reich
c) For making the salute with the arm up, the salute of the SS ¿?
d) For shouting: "Dirty red scum I am going to kill you all"
e) The comments and actions of far right groups defending or trying to mitigate the behaviour of the accused.
In addition to the lengthy prison term, he must now pay the victim’s family 100.000 € compensation and 500 € to one of the antifascists stabbed.

It is expected that the family of Josué will appeal against the sentence.

5rd day Josue trial

Today was the 5th and last day of the trial against Josué Estebanez, it was the time for the conclusions of the parts and the last words of the accused.
The defence of the accused has plead for the free acquittal, considering that the stabbing of Carlos P. as it could be seen in the video recordings was an unwise homicide with the excuse of self-defence and insuperable fear. During two hours the defence has reiterated the version of his defendant, who said that when the antifascist entered in the wagon he was "surrounded" and "had fear". He has also refuted the petition of the public prosecutor of pleading for the aggravating circumstance of "ideological discrimination", because the accused is not militant or activist in any party or political organization of the far right but he has a "neutral ideological personality"
The defence lawyer has described the antifascist group to which Carlos P. belonged (the BAF - Anti Fascist Brigades) as a "criminal gang" , and has stated that these groups "do not have ideology, as well as the nazis neither have it". He has insisted in the fact that Josué "did not attacked people that were making a public display of his ideology, in a political meeting or in a assembly", so in his opinion this aggravating circumstance has no place at all. In the same line he has questioned the trustworthiness of the protected witness in the trial, as he consider that they have a "tribal affinity" with the deceased.
He has stated that his client has no aim of killing at all, and has said also that the knife used was a small pocket-knife as the one used in the army to eat as a expedition piece of cutlery, and that it was in the "minimum of the minimum" of the blade weapons, only maybe above of a nail clipper.
Mavi Muñoz, the mother of Carlos P. has said at the exit of the court that the speech of the defence has been "shameful" and said that "it is clear that Josué has had a defendant with ideas very close to neonazism" Well, it seems that hearing some truths hearts. Perhaps she could also talk about the ideas of the defendant of the private prosecution: Erlantz Ibarrondo, a leftist antifascist militant. He is the lawyer that defence 25 antifascist accused of violent riots, of 7 antifascist accused of assaulting a police station, of the leftist hoolligan of Marsella arrested in a Spanish stadium, and he was also the 51th candidate in the list of the party “Iniciativa Internacionalista” (Internationalist Initiative) for the last European elections, a party that is supported by the ETA terrorists and by all the background that support the vasque separatists and the terrorists.
The particular accusation and the private accusation have embraced the arguments exposed yesterday by the public prosecutor, and have remarked the appropriateness of imposing the aggravating circumstance of "ideological hate", as they think that is proved that the accused had "sympathies with the far right ideas and he committed the crime because the victim had opposite ideas"
Yesterday the president of the Tribunal asked Josué if he wanted to make use of his right to give his last words afters the end of the trial, and Josué said "Yes"
In his speech Josue said "I fell sorry for what I did. Of course I did not wanted to take anybody’s life or harm anybody, but I was very frightened and I did not know how to react. I did not know this was going to go that far'". "I had my life, my work, I had all, but... in a moment, in this circumstances you do not know how you are going to react, and I am very sorry, I did not wanted do anything of that."
With this the trial ended and it is pending of sentence. It is expected that the sentence will be passed in 15 years, although with the Spanish justice you never know, as there are some persons judged by "illegal organization" that since march 2009 are still waiting for a sentence of the court.
When the public was going out of the court, Mavi Muñoz shouted "I wish you the worst of this life" and in the exit, surrounded by the antifascist demonstrators she also said "I am not going to forgive him. I wish him the worst of the worst in this life"
We wish all the best for Josué and we wish that he would get the free acquittal, or the minimum sentence possible.

Σήμερα πραγματοποιήθηκε η δευτέρη συνεδρίαση της δίκης του Josue,με την ακρόαση των αυτοπτών μαρτύρων. Οι περισσότεροι από αυτούς ήταν φίλοι του Carlos Palomino ή άλλοι αντιφά που βρίσκονταν εκείνη τη στιγμή στο τραίνο,οπότε ήταν ξεκάθαρο το τι περιμέναμε από τις καταθέσεις τους. Συνολικά υπάρχουν 17 μάρτυρες εκ των οποίων οι 10 είναι υπό προστασία.Οι φίλοι του Carlos κατέθεσαν ότι μαχαιρώθηκε "χωρίς να υπάρξει κάποια λογομαχία" και πως ο Carlos δεν είχε καθόλου περιθώριο να αντιδράσει καθώς εξεπλάγει από την επίθεση του Josue, που τον μαχαίρωσε στο στήθος,με αποτέλεσμα τον θάνατο του μετά από λίγα λεπτά."Δεν είχε κανένα περιθώριο να αντιδράσει. Ο Josue κινήθηκε κατευθείαν προς αυτόν και τον μαχαίρωσε" είπε ένας από τους μάρτυρες φίλος του Carlos Palomino. Ο Carlos τον πλησίασε και του είπε "Hey,τι μπλούζα είναι αυτή?" - επειδή είχε την υποτιθέμενη νεοναζί μάρκα Three Stroke(όχι και πολύ νεοναζί μιας και σπονσοράρει έναν μαύρο και έναν μιγά jiu-jitsu παλαιστές)- και ο τυπάς τον μαχαίρωσε κατευθείαν μετά από αυτό". "Ολα έγιναν τόσο γρήγορα. Αρχίσαμε να λέμε μεταξύ μας ότι έχει κάποιο αιχμηρό αντικείμενο. Οταν τελικά το συνειδητοποιήσαμε ο Carlos είχε ήδη μαχαιρωθεί. Μια απο τις αντιφασίστριες είπε ότι όταν είδε το μαχαίρι προσπάθησε να προειδοποιήσει τον Carlos, αλλά όταν το φώναξε το μαχαίρι βρισκόταν ήδη στον αέρα."Οι πρώτοι 7 μάρτυρες αναγνώρισαν την μπλούζα του Josue ως μια από αυτές που φοράνε οι ναζί στη Μαδρίτη. Αλλοι φίλοι του Carlos είπαν ότι ο Josue φώναξε "Ελάτε,ελάτε ρε,θα σας σκοτώσω όλους". Αλλοι είδαν τον Carlos στην πλατφόρμα,μετά την επίθεση,και τους είπε "με μαχαίρωσαν". Αλλοι πάλι είπαν ότι ο Carlos έπεσε στο πάτωμα αφού περπάτησε 30 μέτρα.Ένας επιθεωρητής του μετρό είπε ότι, εκτός από το μαχαίρι του κατηγορουμένου, δεν είδε άλλο όπλο και ότι ο κόσμος που ήταν στην πλατφόρμα δεν προκάλεσαν καμία διαταραχή της ειρήνης ή της τάξης. Άλλος μάρτυρας ήταν και ένας σεκιουριτάς, που κατέφτασε μετά το γεγονός και δήλωσε ότι ο κατηγορούμενος δεν ζήτησε βοήθεια για να βγει και ότι είδε τους άλλους μαχαιρωμένους «Είδα ένα τύπο με αίματα στα χέρια και στα ρούχα και φοβήθηκα»Όλοι οι αντιφασίστες μάρτυρες δήλωσαν ότι δεν είχαν όπλα, άλλα κουβαλούσαν μόνο σφυρίχτρες για να υπερκαλύψουν τις «ρατσιστικές βρισιές» που θα ακούγονταν στη συγκέντρωση της Democracia Nacional. Ο δικηγόρος της υπεράσπισης τους ρώτησε αν είδαν κάποιον από τους άλλους (αντιφασίστες) να έχει «όπλο, σιδερογροθιά, ή πτυσσόμενο ή ρόπαλο του baseball», στην οποία ερώτηση απάντησαν «Όχι».Η ερώτηση αυτή αναστάτωσε την οικογένεια του θύματος. Ενοχλήθηκαν επίσης όταν ο δικηγόρος υπεράσπισης ρωτούσε επίμονα αν μία ομάδα αντιφασιστών περικύκλωσε το βαγόνι στο οποίο βρισκόταν ο Josue, για να δώσει έμφαση στην εκδοχή του Josue, ότι δηλαδή μαχαίρωσε τον Palomino επειδή φοβήθηκε ότι θα περικυκλωθεί από εχθρικά άτομα που του φώναζαν και είχαν όπλα. Οι σεκιουρητάδες που βοήθησαν το θύμα δήλωσαν ότι πριν το συμβάν δεν υπήρχε αναστάτωση στον σταθμό. «Δεν είχαν σημαίες ούτε παλούκια. Περπατούσαν κανονικά και μιλούσαν μεταξύ τους. Ρώτησα έναν από αυτούς που πήγαιναν και μου απάντησε σε ένα ματς της Getafe FC».Ένας τρίτος σεκιουριτάς δήλωσε ότι όταν προσπάθησε να βοηθήσει τον Palomino που «αιμορραγούσε και τρίκλιζε», ένας αντιφασίστας τον χτύπησε με τον αγκώνα στο σαγόνι, και ο σεκιουριτάς νόμισε ότι είδε τη λάμψη από ένα αιχμηρό όπλο, αν και είπε ότι δεν νομίζει ότι ήθελαν να τον βλάψουν γιατί μετά από λίγο έκαναν χώρο ώστε να βοηθήσει το θύμα. «Αν ήθελαν να με δείρουν, θα το είχαν κάνει. Νομίζω ότι ήταν αμυντικής φύσης η σκέψη τους, γιατί θεώρησαν ότι θα τους επιτεθώ».Εκτός από ότι συνέβη στο δικαστήριο, σήμερα το πρωί σε διάφορες πόλεις της Ισπανίας, το νερό σε κάποια σιντριβάνια είχε βαφτεί κόκκινο. 4rd day Josue trial

Raquel Muñoz, the public prosecutor in the trial of the death of Carlos P. has increased today his petition of sentence from 29 years to 30 years, as she consider that the maximum sentence should be imposed for the crime of murder with the aggravating circumstance of ideological motivation due to his clothing and the expressions he shouted, and for the crime of attempt of homicide. She considers that is proved that Josué acted against Carlos P. by "ideological discrimination". As she told this is proved by the clothing he was wearing "typical of the neonazis of Madrid", because he made the fascist salute, and because he called the youths "guarros" (filthy pig) that is how the right-wingers call the left-wingers. The public prosecutor has made also reference to various documents that have been read in the court by petition of the private prosecution that collect signs of support for Josué from groups of the far right, pointing that "he is considerer a martyr of his cause".
The public prosecutor deny all the arguments / excuses of the defense, and plead "For the crime of murder: 20 years of prison and prohibition from holding any public office during the same time, with the aggravating circumstance of xenophobia ; for the crime of attempt of homicide: 9 years, 11 months and 29 years of prison ; for the crime of injuries: 2 months of penalty with a monthly fee of 10 years." The public prosecutor emphasized the fact that Josue Estebanez "controlled the situation in every moment" as he prepared and hide the homicide weapon before the group of Carlos P. entered in the wagon where the crimes were committed.

The private prosecution that represents the family of Carlos P. maintained their petition of 37 years of prison for murder, attempt of homicide, threatens and illicit possession of weapons. The public prosecution, represented by the Non Governmental Organization "Movimiento Contra la Intolerancia" (Movement Against Intolerance) plead for the same sentence that the public prosecutor
The defense plead for 6 months of prison for homicide and 3 months for severe injuries, considering in the first crime the defences / excuse of self-defense, state of necessity to avoid an evil/worst harm (his own death) and insuperable fear. The accused has passed nearly two years in preventive prison, so if this is the sentence he would not serve this time. The defense lawyer said that it has been completely proved that his client was in risk of death if he had not found the two policemen that protected him from receiving a death beating from the friends of Carlos P. He was "surrounded, cornered and threatened" and he acted to "defend his life". He said that the crime was in fact a "negligent homicide", something that goes in the line of the statement of the accused.
The public prosecution has denied this excuses, as she said that the attitude of Josue that could be seen in the video recordings was "incompatible with a fear state", as in the video it could be seen that he prepared the weapon, he places himself in front of the door and do not ask for help neither tried to escape. "The rest is who had fear" and said that "although is true that he end surrounded, this was not a result of an intention of surround him, but for the huge number of people that was in the wagon". About the excuse of self-defense she said that it is not applicable as there was no previous aggression, although it is not proved that there was a provocation by Carlos P. who only tells him something about the sweater he was wearing"
"This is one of the rare trials where we have images of most of the events, what gives to it an unusual objectivity. Here take sense the phrase "One image worth for 1.000 words"
Tomorrow will finish the reports of the prosecutors. The trial will end and will be pending of sentence after the last words of the accused, how might apologize to the family of Carlos P. as his lawyer said.
In any case according to the Spanish laws the maximum time that Josué will have to serve is 20 years, and he has already served almost 2 years, one of them in a military prison.

3rd day Josue trial

Today was the 3rd session of the trial, with 9 witnesses: the two local police agents that arrested Josue, a police inspector of the Information Brigade specialized in "urban tribes", and the security chief oh the underground. Other witness are an Ecuadorian soldier colleague of Josue in the army, and four high ranks of the Army: a colonel, a lieutenant colonel, a lieutenant and a brigade. This four were called by the accusation to clarify, among other things, if the knife was provided by the army.

The chief of the XXI of the National police, specialized in urban tribes and ideology extremists and with 12 years of experience, has declared as "legal expert". He said after seeing the images of the accused the day of the incident that "this is a neonazi skin". This was based in the fact that he as wearing a sweater of the brand “three stroke” and by his physical appearance, as he had the head shaved. He said in various occasions that is possible to identify the ideology of the extremist by his esthetic. (The only
thing is that the soldiers in the Spanish army used to have the hair shaved, like the skinheads, and wear military clothing or the official trouser of the army that has the Spanish flag on his sides)

The defense lawyer gave to the "expert policeman" some images of the three-stroke website. The judge said "Do you mean this paper that says spring - summer collection?". The police expert" said then that the sweater, by it self, did not need to be considered as peculiar of neonazis. “This garment could be worn by any person” said the policeman. The defense lawyer said then, “Please notice that these clothes could be worn by anybody. It could be sell in a department store" to play down the importance of the declaration of the policeman.

The importance that this sweater is having in the trial is so, that according to the press it seems that If Josue has not wore that sweater that day nothing would have happened.

Version 1 is of Carlos Palomino's friends. "We entered in the wagon and we were al shocked by seeing this guy with this sweater, a sweater that only the neonazis wear. We were so shocked that no one said anything, we were speechless. Only Carlos dare to ask him about the sweater, and he was stabbed without crossing any word. Carlos only asked. "And this sweater?", he did not have time to say anything more." Other friend said. "Carlos touched his chest and asked him about the sweater", nothing more.

Version 2 is of the alleged homicidal "He pushed me in the chest or in the stomach, I do not rember well, and he told me "give me the sweater and all that you have" This his his version, he was punched by Carlos P. and he tried to rob him, what united to the threats supposedly said by the antifascists, and the brass knuckle and the knife supposedly brandish by the left wingers, could justify the defenses/argument of self-defense".

As a result of the insistence of the defense lawyer about the supposedly "nazi" affiliation of the brand, some friends of Carlos P. said "It is always wore by nazis" The defense lawyer asked the witness one time and another "But what has this sweater of Nazi?" and the witness reply "And what do I know, but the nazis wore it" Other said "I live in Alcala de Henares, there are many nazis and they wear this brand"



The two policemen that arrested Josue said that a big crowd was following him shouting "you have killed our friend, we are going to kill you!". The two local policemen saw Josue after going out of the underground. There were the 12:15 pm of the 11 of November of 2007. There are no images of the previous moments of the arrest. While he was running by the Bolivar st, at 25 meters of the agents, they saw him throwing an undetermined object. Josue reach the policeman and asked them for protection against "the people that were chasing him and were going to kill him". The three went behind the car and they were surrounded by the crowd "that started to hit us". They tried to reject the aggression with their truncheons. The accused was behind the policemen, and did not tried to defend himself. "We can avoid receiving some pushing’s, punches, and wounds" according to the police statement that was made later. They did not arrest or took the data of anyone due to their aggressive attitude. The accused was wounded as he received some kicks and punch in the eyes. He had the risk of being killed by a beating. They called an ambulance and the accused was sent to the Saint Charles Clinic Hospital. They search him and found a brass knuckle in the right pocket of his track trouser. The defense said that Josue took it and keep it while he was being beaten. One of the popular accusations used this fact to accuse him of "possession of illegal weapon"

One of the policemen said that Josue was "very calm" when he was arrested.

The declaration of the four high ranks of the army did not make much contribution, as all said that they did not know personally the accused. They were asked about the military instruction of the accused and about the knife “This knife is given as a expedition piece of cutlery. It has to be open with both hands and has no fastener, so it could be closed in a moment.”


Before the trial in the preliminary investigation, it was found that the accused had not caused any problem neither had bad behavior in the year he had been serving in the "batallón de honores del Regimiento Inmemorial del Rey del Ejército de Tierra" (Honour battallion of the King's Immemorial Regiment of the Army)

His room mate in the army, a soldier of Ecuadorian origin. Said that Josue did not seem racist in his opinion, but that his relation was only limited to the army base. "I have never sawn any sign of racism in any moment. He was my friend. He keep me company. He was very quiet" . "He was a quiet persons, pacific and with a good relation with the immigrants in his unit". "He was never involved in a violent incident". He's only arrest was for having the uniform wrinkled.

In this session most of the CCTV recordings of the underground have been shown, in one of them it could bee seen how the accused pulled out the knife and stab Carlos P. in the chest.

The accusation has shown also a photo, provided by the "antifascist coordinating committee" of Madrid where a young man can be shown with his right arm raised, which is supposed to be a photo of the accused years ago. It has been discovered that this is not josue in the photo, but that is a photo of Bulgarian hooligans without any relation with Josue.

With this finish the first week of the trial against Josue.

More CCTV recordings will be shown in the 4th session of the trial, and analyzed by legal experts. It is also expected to have the first conclusions of the trial.

Josué Estébanez of 25 years old, was born and risen in Galdacano, a working class locality in the outskirts of Bilbao, in the Vasque region in the north of Spain. There in a block lives his mother, his grandparent and his brother. His father, Bernardo, died 10 years ago. His brother at the time of the incident lived with Josue in a flat in Fuenlabrada, a city in the Madrid region, but he had to flee as he was threatened by the leftwingers.


His mother Victoria, is in Madrid for the trial, and seems that has not talked about the crime with anybody of his family. The grandfather of Josue, in his 80's, remembered that Josue had worked as electrician in some constructions, and he thought that this was still his job. "I have not seen him since some years ago. I know that he has been in Almeria and in Madrid, working in his profession". The grandmother said that "They do not told me anything. The only thing I know is that I have not seen my grandson since a year ago". The family has concealed he fact that Josue had join the army, something common in the Vasque region due to the threats of the ETA terrorist and his political branch. The neighbourhoods remember his family as normal and discreet. They remember that before dying, the father was employed in a company. "The sons have not been seen here since long time ago, and she didn't talked too much about them" A cousin of Victoria, said "We are a normal family and we do not want to know a thing about this event. All the family is affected"

2nd day Josue Trial

Today was the second season of the trial, with the declaration of some witness of the incident in the underground. Most of them were friends of Carlos Palomino or antifascist that were in the train, so It was clear what can be expected from their declarations. There are 17 witness, 10 of them are "protected witness".
The friends of Carlos said that he was stabbed "without crossing words" and that Carlos has no time to react as he was surprised by the attack of Josue, who stab him in the chest and as a result of this died some minutes after
"He has no time to react. Josue rush towards him directly and stab him" told one of the witness, friend of Carlos Palomino. This witness explained that Josue threatened all the persons that tried to disarm him with the words "I am going to kill you all, shitty red scum (guarros de mierda)" and at the same time he shouted 'Sieg heil' with his arm up, like the nazi salute.
Other witness said that Josue hide the knife behind his back, moments before the antifascists entered in the wagon. This circumstance of the preparation of the weapon is a relevant fact why the public prosecutor is accusing Josue of assassination and not of homicide, what implies that the sentence could be higher. (17 years)
"He was in a corner with the knife ready, hide behind his back. Carlos approached and said "Hey, this sweater?" - of the supposed neonazi brand three stroke (not very neonazi as they sponsor black and mestizo jiu-jitsu fighters)- The guy stab him directly after that. "All was very fast. We started to say that he was carrying a sharp weapon. When we finally realized, Carlos have been already stabbed. One of the antifascist girls told that when she saw the knife tried to alert Carlos Palomino, but when I shouted the guy had the knife in the air."
The first 7 witness identified the sweater Josue was carrying as the ones used by the nazis in Madrid. Other friends of Carlos said that Josue shouted "Come, Come on, I am going to kill you all". Other saw Carlos in the platform, after the aggression, and he told me "They have stabbed me" Other told that Carlos fail to the ground after walking 30 meters"
One underground sub inspector told that apart from the knife the accused was carrying, he din not saw any other weapon, and that the people that were in the platform was people that was not causing a breach of the peace or of the order. Other witness was a security guard, that arrived after the incident, that told that the accused did not ask for help to go out of there, and that he saw other of the guys stabbed "I saw a guy with blood in the hands and in the clothes and I was scared"
All the antifascist witness told that they had no weapons, they were only carrying whistles to silence the "racist consigns" that were going to be shouted in the demonstration of Democracia Nacional. The lawyer of the defense asked to the witness if they saw any of the youngsters carrying "weapons, brass knuckles, sticks or baseball bats" to what they replied "No".
This question upset the family of the victim. They were also upset when the defense lawyer insisted in asking if a group of 50 antifascists surrounded the door of the wagon where Josue was, to give credibility in this way to the version of the accused, that said that he stabbed Palomino because "he was scared" of being surrounded by persons with weapons shouting to him.
The security guards that helped the victim told that before the aggression there was no alteration in the underground station. "They were not carrying flags neither sticks. They were walking correctly, talking among them. I asked one of them where they were going and he told me that to a football match of Getafe FC"
Other security guard, the one that tries to clam the situation inside the wagon in the video told that "My idea was to try, as far as I could, to avoid that anybody come close to him". She said that the people shouted her "Catch him! catch him!" but he couldn't. She was scared. After this she lost conscience because someone sprinkle her face with CS Gas. The next day we took a sick leave as she discovered that was 1 month and a half pregnant.
