No passado Sábado, a Juventude Nacional da Holanda, organizou uma manifestação de solidariedade para com o Josué Estebanez na cidade de Haia. Mais de setenta camaradas reuniram-se para exigir a libertação dos presos políticos e promover a solidariedade com Josué Estebanez. Entre estes, estavam as delegações da NSA/ANS, RVF, B&H, AKV e NSA.

Por volta das 14.00 a manifestação teve inicio na zona de Malieveld em direcção à Embaixada de Espanha. O primeiro camarada a discursar foi Brian Van Houdt da Juventude Nacional da Holanda. As palavras proferidas incidiam na injustiça do sistema judicial, «que muitas vezes penaliza todos aqueles que são nacionalistas» e que «devemos continuar com a luta, pois no dia em que o sistema colapsar, os nossos camaradas serão novamente livres.»

Depois foi a vez de Mark Atkinson da RVF, de apelar a uma maior unidade entre os nacionalistas e terminar com as “guerrinhas” entre irmãos. O último discurso esteve a cargo de Ruben Rogiers em nome da NSA. No seu discurso, referiu a importância de não nos fecharmos em nós próprios, mas sim descobrir de que forma pudemos contribuir para o movimento e para a nossa luta política, senão, de outra forma o Josué estará preso em vão.

Nota: Recorde-se que Josué foi condenado o ano passado, a 26 anos de prisão (+ 100 mil euros de indemnização) por se defender de um linchamento garantido por parte de dezenas de jovens (provado em Tribunal que estavam armados, que tinham historial de violência, e que entraram no metro com o intuito de agredir Josué) no metro de Madrid em Novembro de 2007. No entanto, o Ministério Público espanhol, argumentou que o seu crime foi não em legitima defesa, mas sim politicamente motivado. Porquê? Por ser nacionalista.

SOLIDARITY MARCH FOR JOSUÉ (Nederlands).

On Saturday the twentieth of November the National Youth Netherlands organised a march for solidarity at The Hague in the Netherlands. Over seventy comrades gathered to plead for the release of political prisoners and to advocate their solidarity with Josué Estébanez. Among them were delegations from NSA/ANS, Racial Volunteer Force, Blood and Honour, Autonome Kameraden Vlaanderen and the Nieuw-Solidaristisch Alternatief.

At approximately 14:00 hours the demonstration began at the Malieveld in the direction of the Spanish embassy. First to speech was Brian van Houdt for the National Youth Netherlands. He spoke out against the unfair judicial system, which nationalists often have to deal with. We must continue the fight, because when the system collapses, our comrades can finally live in freedom again. After this Mark Atkinson from the Racial Volunteer Force held a speech in which he called out for more unity and the end of brotherly wars. The last to speech was from Ruben Rogiers in the name of the Nieuw-Solidaristisch Alternatief. In his speech he claimed that we should definitely not lock ourselves up. We need to look at ourselves to find out what we can contribute to our movement and to our political struggle, or else Josué is locked up for nothing.

After this the demonstration moved towards the Central Station, at which the demonstration ended. It was a successful demonstration. The number of organisations present, clearly showed that it is possible to work together and stand side by side in our struggle. There was no opposition of the antifa. Through this manner we would like to thank everyone who was present to demonstrate for the freedom of political prisoners and to express their solidarity with Josué!

Current situation of Josué.

Some days ago, Josué was moved to a new prison in Asturias (the north os Spain), and only their relatives are allowed to send him mail or to visit him by the moment. As soon as he can receive letters or visits again we will post his new address.

The account number still be the same, and solidarity is still accepted.

We take this opportunity to thank all the people that follows this case, people who day after day claim for justice for Josué and also to the people who write him and give him strength to stand.

Současná situace (the current situation - Czech readers):

Vzhledem k novým faktům týkajících se Josuého jsme se rozhodli aktualizovat náš blog. Chceme, aby lidé věděli o jeho současné situaci, o které nás informoval přímo on a jeho rodina.

Po obdržení rozsudku k 26-ti letům vězení s přitěžujícím faktem ideologické nesnášenlivosti, tedy rozsudku, který ještě nikdy ve Španělsku nezazněl (a to ani v případě ETA teroristy De Juana Chaose, který zabil 25 lidí), bylo podáno odvolání k Vyššímu soudu. Ten však potvrdil rozhodnutí Okresního soudu v Madridu.

Okamžitě byla podána stížnost k Ústavnímu soudu a odvolání a stížnosti budou pokračovat, dokud se nepodaří najít spravedlnost. Pokud nenajdeme pomoc ve Španělsku, jsme připraveni jít s případem až k Evropskému soudu pro lidská práva ve Štrasburku.

Jako by nepřiměřený trest nebyl šílený sám o sobě, Josué navíc dostal mnoho neobvyklých omezení, z nichž nejhorší jsou tyto:

1. Josué byl zařazen do FIES režimu (což je kategorie dávána teroristům a překupníkům) se všemi omezeními, které k tomu náleží.

2. Bez jakéhokoliv předběžného sdělení byl přesunut do vězení v Cádiz, tedy ještě dále od jeho rodiny.

3. Bylo mu zakázáno obdržování akademických knih, takže ve vězení nemůže studovat (je nutno podotknout, že běžně je studium mezi vězni silně podporováno).

4. Zabírání do vězení zaslaných oděvů, hudby a časopisů (ve Španělsku jinak povolené) a cenzura dopisů (taktéž na španělské poměry velmi neobvyklé).

5. Zákaz zúčastnění se v integračních vězeňských aktivitách (jako například asistence ve vězeňské knihovně nebo tělocvičně) a zákaz vstupu na vězeňský dvůr.

6. Odepření většiny požádaných návštěv.

My budeme pokračovat v boji za spravedlnost pro Josuého, protože obrana vlastního života není zločin. Naší prioritou je momentálně jeho přesun do vězení blízko jeho domova, aby ho mohla navštěvovat rodina bez zbytečných komplikací. Pamatujte na solidaritu s jeho situací, neboť dnes je to on, ale zítra to můžete být VY!

Josué soud - Czech readers (České čtenáře)

11.listopadu 2007 vešel do stanice metra Legazpi v Madridu dav extrémně levicových aktivisů. Byli tam, stejně jako další podobní aktivisté v Madridu, s jediným úmyslem – napadnout každého, koho by považovali za “španělského patriota”, jelikož ve stejnou dobu a nedaleko od místa se konalo shromáždění organizované nacionalistickou Španělskou stranou. Toto shromáždění bylo legální a povolené místními úřady. Levicoví aktivisté chtěli shromáždění narušit a útočit na tolik lidí, kolik by se přihodilo. To byl jejich jediný účel.
V tu chvíli přijel do stanice metra vlak, v němž byl Josué Estebanez. Člověk, jehož vzhled mohl okamžitě sloužit pro provokaci z řad levicových extremistů, kteří mezitím zaplnili celou stanici. Josué měl na sobě mikinu značky „three stroke”, která je mezi nacionalisty ve Španělsku velmi rozšířená a sportovní kalhoty se španělskou trikolórou – to byl jeho v tu chvíli jeho přestupek. Josué spatřil z okna vagónu velkou skupinu antifašistů a okamžitě rozpoznal nebezpečí, ve kterém se ocitl. Zatímco on byl uvnitř vagónu sám, na stanici bylo kolem 50 agresivních výtržníků hledajících svoji oběť. Rozhodl se bránit svůj život a své zdraví – připravil si nůž na svoji obranu a čekal na zastavení metra. Tento akt - připravení si nože předem a údajné chladnokrevné vyčkávání – je médii a levičáky označován jako důkaz spáchané vraždy. Stejně Josuému přitížil údajný fakt, že mohl vagón kdykoliv opustit místo toho, aby čekal na konflikt. Popřípadně, že mohl utéct. Proč by však člověk, který se ničeho nedopustil, měl utíkat? Všichni mohou navíc na videu vidět, kolik dalších „aktivistů” čekalo venku.

Když se vagón začal zaplňovat mladými agresivními antifašisty, okamžitě si všimli Josuého a seskupovali se kolem něj, čekající na někoho, kdo by konflikt začal. Na videu z průmyslové kamery, která se rozšířila v médiích, můžete na čase 00.39 vidět jednoho levičáka, jak si nasazuje boxer, další se na Josuého jen pochechtávají. Z videa lze také usoudit, že Josué se chystal metro opustit, ale možná viděl, že situace by byla stejná. Ona situace, která eskalovala, když dovnitř vstoupil Carlos Javier Palomino a okamžitě strčil do Josuého s poukazem na jeho oblečení.
Všichni racionálně uvažující lidé ví, co se bude v takové situaci dít dále. Víme, že Carlos by nezačal s Josuém probírat témata jako ctnosti mezinárodního socialismu nebo znárodňování bank. Ne. My víme, že dalším krokem po obyčejném šťouchnutí je rána pěstí nebo boxerem, kopance do žeber, když člověk leží na zemi a nebo dokonce rána nožem. A Josué nechtěl skončit v nemocnici v kómatu. Josué nechtěl být další obětí levicové lůzy, jako jí byl Eduardo Garcia Gelber, kterého levičáci zabili před několika lety v Barceloně za podobných okolností. Ne, Josué se rozhodl bránit svůj život! Bodl Carlose nožem a posléze se bránil útokům dalších antifašistů. Za tento krok si vysloužil obvinění z vraždy a z Carlose se stal „nevinný mučedník zabitý zlým neonacistou”! Dále si Josué vysloužil obvinění z pokusu o vraždu, když později nožem bodl dalšího útočníka, který na Josuého skočil zezadu. V celém obvinění nebylo absolutně bráno v potaz, jaké nátury byli oni lidé, kteří se do konfliktu s Josuém dostali. Nebyla absolutně brána v potaz jejich kriminální minulost, kde Carlos Javier Palomino byl radikálním levicovým chuligánem a velmi známou firmou při vyvolávání pouličních bitek a propagace násilí. Jakékoliv podklady k tomuto byly médii, vyšetřovateli i antifašisty popřeny a bylo řečeno, že vražda je vraždou. Na druhou stranu bylo od první chvíle velmi důležité prokázat, že Josué je členem nebo sympatizantem nějaké extrémně pravicové strany. Jako by příslušnost nebo sympatie okamžitě znamenaly důkaz viny. Žel, víme, že právě o toto u většiny soudů s nacionalisty jde.
Je absolutně nedůležité pro celou situaci, zda Josué byl zastáncem nějaké ideologie nebo ne. Jestli měl rád fotbal nebo býčí zápasy. Josué prostě cestoval metrem – a cestoval sám. Josué byl napaden padesáti antifašisty, kteří měli ono ráno jen jeden cíl – čelit „fašismu” násilím. To je zřejmé z prvních chvílí videa, a argument, že Carlos Josuého jen zatahal za mikinu bez nějakých vážnějších úmyslů je směšný. Všichni víme, co by následovalo, kdyby Josué nezareagoval první. A ti, kteří to popírají, se nikdy neocitli v podobné situaci a jsou pravděpodobně velmi naivní.
Chci být další, kdo šíří pravdu o tomto případu, a proto jsem se připojil k lidem z celého světa, kteří překládají anglické a španělské stránky do svého jazyku, aby se tato pravda šířila dále. Nenechme, aby se lidé dozvídali jen překroucené informace z masmédií a pokrytecký popis událostí, jak jej podávají Madridští levicoví extremisté. Nenechme aby se takhle překroucený popis událostí dostal mezi naše známé – kolegy v práci, kamarády, rodinu, ...
Systém si pohrává s životem muže, který jen udělal to, co by každý správný člověk udělal na jeho místě: BRÁNIL SVŮJ ŽIVOT.
My chceme spravedlnost a svobodu pro Josuého, obrana vlastního života není zločin !

Trial:

Záznam z prvního dne soudního líčení:

Dne 16.září začalo soudní líčení s Josuém Estébanezem obviněným z vraždy antifašisty Carlose Palomina a z pokusu o vraždu dalšího antifašisty. Veřejný žalobce požadoval trest 17 let za první obvinění a 12 let za druhé.

Obžaloba požadovala trest ve výši 37 let: 20 let za vraždu, 10 za pokus o vraždu, 4 za zastrašování a 3 za nelegální držení zbraně. Obvinění také vyrukovalo s přihoršujícím “ideologicky motivovaným zločinem”. Soudní líčení probíhalo v ranních hodinách od 9:00 do 12:00 a mělo skončit 24.září 2009. První týden bude určen výslechu a výpovědi Josuého a 17-ti svědků, z nichž deset je utajených. Ke konci týdne budou vyslechnuti někteří Josuého armádní nadřízení a kolegové.

Další týden bude určen výpovědím 6 státem uznaných expertů na rozdílnou problematiku a bude pouštěn záznam z bezpečnostní kamery z metra.

Poslední dva dny budou ponechány pro konečný rozsudek.

Ve své výpovědi obviněný uvádí:

„Viděl jsem na nástupišti pankáče a skinheady. Někteří na mne ukazovali a křičeli “dostaneme ho” a vykřikovali na mne další výhružky. Měl jsem strach, tak jsem z kapsy vytáhl oficiální armádní nůž. Oni mezitím nastoupili do vagónu a já byl postupně obestoupen lidmi, kteří měli zbraně. Řekli mi „ty nikam nejdeš, zasraný fašoune”. Viděl jsem u jednoho pěstního boxera a u jednoho nůž, neustále mi říkali, že mne zabijí. Jeden z nich na mne ukázal a druhý si nasadil boxera. Další nastoupil do vagónu a razil si cestu skrz ostatní. Zablokoval mi cestu a chtěl po mne moji mikinu a peníze. Můj instinkt zareagoval, cítil jsem, že na mne chtějí zaútočit a že se z tama živý nedostanu. Bodl jsem ho, protože jsem byl vyděšený. Pak jsem zkoušel odrážet útočníky a dostat se ven hned, jak budu mít příležitost. Když jsem konečně vyběhl z vagónu a ze stanice, tihle lidé se mne snažili chytit. Doběhl jsem k jedné policejní hlídce a žádal o pomoc, ale oni lidé mne doběhli a začali mne bít.”

Josué prohlásil, že u sebe měl armádní nůž, neboť další den se u jeho oddílu konaly armádní manévry a že se nechystal na demonstraci strany Democracia Nacional v Usera, ale chtěl jít na oběd s několika přátely v sousedství Villaverde.

Také řekl, že si nebyl vědom toho, že značka 'Three Stroke', jejíž mikinu na sobě měl, je značkou extrémní pravice, neboť ji dostal darem od kamaráda, který dělá kickbox.

Když byl obžalobou otázán, zda je neonacistou, odpověděl, že není. Když byl otázán, zda je patriotem, odpověděl: “jsem jen Španěl, někdo, kdo je rád, když jeho národní tým vyhraje utkání”. Dále byl otázán právníkem, zastupujícím hnutí proti intoleranci (Movimiento contra la Intolerancia), zda se mu líbí víc Francovo fašistické Španělsko než současné demokratické a Josué odvětil: „Jak můžu mít rád Francovo Španělsko, když jsem příliš mladý na to, abych ho zažil?”. Také popřel, že by kdy vykřikoval pozdrav „Sieg Heil” a že si není vědom jeho významu.

V dalším výslechu uvedl, že necítí nenávist vůči antifašistům ani vůči imigrantům. Řekl, jak by mohl cítit nenávist vůči imigrantům, když jsou někteří jeho kamarádi a když jeho armádní kolega, se kterým sdílí pokoj, je imigrant.

Josué byl otázán, zda si myslí, že antifašisté nejsou patrioti. Odpověděl, že nemůže říct, neboť se s nikým z nich nikdy nebavil a že neví...že však někteří, které zná, nevěří v národovectví. Při otázce, zda dostal armádní instrukce a výcvik uvedl, že byl specializován na vojenské přehlídky a že nebyl trénován na použití útočných zbraní. Nůž, který u sebe měl v době incidentu, byl oficiálním armádním nožem, který používal k řezání provazů, k loupání ovoce apod.

Popřel, že by dělal nacistický pozdrav uvnitř vagónu. Prý jen ukazoval na určité lidi a křičel na ně, aby odešli.

Obviněný také několikrát odmítl, že by byl členem nebo sympatizantem nějaké politické strany, či že by měl předsudky proti imigrantům.

Jeho právník, Enrique Martin, vyzdvihoval, aby soud zanechal stranou politiku, prohlásil: „Jsme u soudu a musíme zde jednat podle zákona.” Podle jeho přesvědčení, ona skupina lidí si mohla podle Josuého vzhledu myslet, že se chystal na demonstraci zmíněné pravicové strany.

Josué držel oční kontakt téměř po celou dobu se všemi lidmi, kteří k němu u soudu mluvili a odpovídal bez váhání na otázky sedmi právníků, jedné po druhé.

Po jeho výslechu proběhlo krátké prohlášení Carlosovi matky. Řekla, že věděla, že její syn šel na protinacistickou demonstraci a že jediná věc kterou mu při odchodu řekla, bylo „buď opatrný, mohou tam být problémy.” Dále uvedla, že její syn měl antifašistické názory, ale že nechodil často na demonstrace, spíše šel v onu dobu zrovna podpořit nějaké jeho kamarády.

Někteří z přátel Carlose Palomina, kteří byli na místě činu, také vypovídali. Uvedli, že Carlos řekl Josuému jen „hej, chlape”, neboť byl překvapen, že na něm vidí mikinu, kterou nosí neonacisté. Po pobodání Carlose Josué údajně vykřikoval nacistický pozdrav a výhružky jako „zabiju vás všechny vy rudé prasata”.

Při vstupu do soudní haly postávala skupina antifašistů s transparenty jako „Carlosi, bratře, my nezapomeneme” a „Tvá vražda nezůstane nepomstěna”.

Ke konci líčení začali dvě mladé nacionalistky rozdávat podomácku udělané letáky na podporu Josuého. Jeden z hrdinných antifašistů jednu dívku udeřil a musela zasáhnout policie.

Žádná organizovaná demonstrace nebo podpora pro Josuého u soudu nebyla dělána jedinou nacionalistickou skupinou, neboť to by mu jen uškodilo. Josué chtěl spravedlivý soud a ne politický soud.

Záznam ze druhého dne soudního líčení:

Proběhl výslech další svědků incidentu, většina z nich byli přátelé Carlose Palomina nebo antifašisté, kteří byli kolem. Podle toho lze usoudit, jak probíhaly výpovědi. Celkem bylo vyslechnuto 17 svědků, 10 z nich bylo utajených.

Přátelé Carlose většinou říkali, že byl pobodán bez „výměny slov“ a že byl útokem Josuého velmi zaskočen. „Neměl čas zareagovat, Josué se na něj vyřítil a bodl ho rovnou do hrudníku,“ řekl jeden z Carlosových přátel. Stejný svědek vysvětloval, jak Josué zastrašoval ostatní mezi tím, co se ho snažili odzbrojit a jak na ně vykřikoval: „zabiju vás všechny, vy špinavé rudé svině“ a ve stejnou dobu „hajloval“.

Další svědci popsali, jak Josué skrýval nůž za zády, než víc antifašistů vešlo do vagónu. Situace přípravy zbraně je hlavním faktem, proč veřejná žaloba obvinila Josuého z vraždy a ne ze zabití, kde je trest nižší.

„Stál v rohu a schovával svůj připravený nůž za zády. Carlos k němu přišel a zeptal se: „hej, co ta mikina?“, protože měl na sobě neonacistickou mikinu. Ten chlap ho hned potom bodl, všechno to bylo hrozně rychlé. Začali jsme si povídat, že má u sebe nůž, ale jak jsme si to celé uvědomili, Carlos už byl pobodaný. Jedna holka mi říkala, že zkusila Carlose varovat, ale nůž byl už ve vzduchu“, prohlašoval další svědek.

Prvních sedm svědků identifikovalo mikinu, kterou na sobě Josué měl, jako takovou, kterou nosí neonacisté v Madridu.

Další svědek viděl Carlose na nástupišti poté, co byl pobodán a Carlos mu údajně řekl „on mne bodl“. Někteří uváděli, že Carlos spadl k zemi asi po ujití 30-ti kroků.

Jeden z dozorců v metru uvedl, že kromě nože, kterým byl použit k útoku, neviděl na nástupišti žádné další zbraně. Také, že lidé, kteří byli v tu dobu na nástupišti, nepůsobili dojmem narušovatelů pořádku. Dalším svědkem byl člen ochranky, který dorazil na nástupiště těsně po incidentu. Tento svědek uvedl, že obviněný se nezeptal na pomoc, aby se dostal ven z metra a že viděl dalšího člověka pobodaného. Dále, že si všiml, jak má jeden člověk zakrvácené ruce a oblečení, což ho prý vyděsilo.

Všichni antifašisté, svědčící u soudu, uvedli, že neměli žádné zbraně, ale pouze píšťalky na rušení „rasistických keců“, protože se chystali na demonstraci Democracia Nacional. Obhájce obžalovaného se pokaždé ptal, zda viděli někoho z mladších jedinců nést nějaké zbraně jako boxery, pálky, hole apod., odpověď byla vždy ne.

Tyto otázky pobouřily rodinu Carlose. Vyslovili také pohoršení nad tím, když Josuého právník trval na zodpovězení otázky, zda si svědkové myslí, že Josué, obklopený ve vagónu 50-ti lidmi, se mohl cítit vyděšený a proto Carlose bodl.

Členové ochranky metra uvedli, že před agresí na nástupišti nebyly žádné nepokoje a že lidé nenesli žádné vlajky nebo hole. Údajně se v metru chovali spořádaně a povídali si mezi sebou. Když se v tu dobu jeden z ochranky zeptal, kam tento dav lidí šel, odpověděli mu, že jednou na fotbalové utkání.

Další zaměstnankyně metra, která je zachycen na videu uvnitř vagónu, řekla: „Snažila jsem se zajistit, jak jen to šlo, aby se k němu nikdo nedostal.“ Uvedla dále, že lidé na ni křičeli, ať jej chytí, ale že nemohla. Měla strach. Chvíli poté ztratila vědomí, protože ji někdo do obličeje vstříknul slzný plyn. Den poté musela na nemocenskou, neboť byla v těhotenském stavu.

Třetí člen ochranky u soudu vypověděl, že se snažil pomoci pobodanému, ale jeden z antifašistů ho udeřil loktem do čelisti. Také uvedl, že si všiml dalšího nože, jiného než ten držen Josuém. Vypověděl doslova: „byla to kovová čepel, viděl jsem její záblesk a někdo se mne zkoušel bodnout. Nedokázal jsem identifikovat útočníka, ale asi 30 sekund potom se dav rozestoupil a já mohl pomoci tomu pobodanému. Pokud by mne poté chtěli zbít, mohli to udělat. Myslím si, že na mne útočili z obrany, protože si mysleli, že chci zaútočit já na ně.“

Mezitím co probíhal soud, v mnoha městech ve Španělsku antifašisté obarvili vodu ve fontánách na červeno, aby si tímto vandalským činem připomněli Carlosovu památku. 50 antifašistů bylo během rána u soudní budovy.

Záznam ze třetího dne soudního líčení:

Třetího dne proběhly výslechy devíti svědků. Dvou místních policistů, kteří Josuého zatkli, policejního inspektora z informačního oddělení specializovaného na „městské gangy” a šéfa bezpečnosti podzemních drah. Dále jednoho Ekvádorského vojáka, se kterým Josué sloužil a čtyř výše postavených šarží z armády: důstojníka, poddůstojníka, nadporučíka a brigádníka. Poslední citovaní byli povoláni obžalobou, aby, mezi dalšími věcmi, ujasnili, zda nůž byl skutečně providován armádou.

Vedoucí XXI.oddílu Národní police, specializovaný v „městských ganzích” a ideologických extremistech s dvanácti lety zkušenosti, se prohlásil za „oficiálního experta”. Řekl, že po zhlédnutí obviněného v den incidentu si byl jistý, že jde o neonacistického skinheada. Podložil to převážně faktem nošení mikiny značky „three stroke“ a jeho fyzickou vizáží včetně oholené hlavy. Při různých otázkách během výpovědi několikrát zopakoval, že je možné identifikovat ideologii extremisty jen pohledem na něj. (Nijak však neuvedl fakt, že ve španělské armádě je běžnou věcí vyholená hlava a nošení vojenského oblečení v civilu, stejně jako nošení armádních kalhot, které mají na stranách zobrazení španělské vlajky.)

Obhájce obviněného dal tomuto „policejnímu expertovi“ nějaké obrázky z oficiální internetové stránky Three-stroke. Soudce se otázal: „Máte na mysli tento papír, který uvádí jarní a letní kolekci?“ Policista na to odpověděl, že mikina sama o sobě nemusí být vlastní neonacistům a že tyto oděvy mohou být nošeny kýmkoliv. Obhájce se toho chopil a zdůraznil fakt, že oblečení „three stroke“ může být nošeno kýmkoliv, že jej lze koupit v obyčejných obchodech a zpochybnil tak důležitost tohoto svědectví.

Celá důležitost mikiny a váha, jakou jí dával soud, byla proto, že (převážně s ohledem na tisk) kdyby ji podle všeho Josué na sobě v onen den neměl, nic by se nestalo.

U soudu se probíraly dvě verze útoku. Jedna je ta Carlosových přátel: „Vešli jsme do vagónu a byli zaskočeni tím, že ten kluk nosí mikinu, kterou nosí jen neonacisté. Byli jsme tak zaskočeni, že nikdo nic neřekl, byli jsme úplně zaražení. Jenom Carlos našel odvahu zeptat se ho ohledně oblečení, ale on ho pobodal, aniž by cokoliv řekl.“ Další z jeho přátel uvedl: „Carlos se dotkl jeho hrudníku a zeptal se ho na tu mikinu“, nic víc.

Druhou verzi je údajné zabití. „Bouchnul mne do hrudníku nebo do břicha, nepamatuju si to moc dobře a řekl mi, ať mu dám svou mikinu a všechno, co mám“. To byla verze Josuého, byl údajně bouchnut Carlosem, který ho chtěl okrást. S poukazem na výhružky ostatních antifašistů a toho, že Josué viděl boxer a nůž v rukou dvou jedinců, chtěla obhajoba prosadit argument sebeobrany.

Jako výsledek trvání obhajoby na vysvětlení, proč je oděvní značka three stroke oznámkována jakožto oblečení neonacistů, mu někteří z nich odvětili: „Náckové to vždycky nosí.“ Obhájce se zeptal, co má tato značka a nacismus společného a odpověď jednoho z nich byla: „Co já vím? Já jen vím, že to nosí nacisti.“ Druhý odpověděl: „Já žiju v Alcala de Henares, tam máme hodně nácků a oni nosí tohle oblečení.“

Dva policisté, podílející se na zatčení Josuého, vypověděli, že spatřili obrovský dav pronásledující obviněného a křičející „zabil jsi našeho kamaráda, teď tě zabijeme my“. Nebyly zachyceny žádné fotografie nebo jiné záznamy, jež by předcházely zatčení. Když obviněný běžel směrem k policistům, odhodil neurčitý předmět. Jakmile k nim doběhl, zeptal se na ochranu před lidmi, kteří ho pronásledovali a kteří ho, podle jeho slov, chtěli zabít. Všichni tři se napřed schovali za auto, ale dav je obklíčil a začal na ně útočit. Policisté se snažili odvrátit agresi použitím jejich obušků. Obviněný byl po celou dobu za dvěma policisty a nezkoušel se bránit. Jeden z policistů uvedl později: „Dokážeme se vypořádat s nějakými kopanci, ranami a zraněními“. Nikdo z agresorů útočících na policisty nebyl zatčen, ani nebyla vzata osobní data nikoho ze zůčastněných v agresi. Josué byl zraněn, neboť obdržel nějaké kopance a rány do očí. Byla tam vysoká pravděpodobnost, že jej ubijí k smrti. Policisté zavolali sanitku a odvezli jej do nemocnice Saint Charles. Po prohledání u něj našli boxera. Obhajoba při soudu potvrzovala Josuého verzi, že boxera sebral na ulici, když do něj útočníci kopali a držel ho posléze u sebe. Josué byl proto obviněn za „držení nelegální zbraně“.

Jeden z policistů uvedl, že Josué byl „velmi klidný“ zatímco jej zatýkali.

Výslech armádních představitelů nepřinesl mnoho nového, neboť nikdo z nich Josuého neznal osobně. Byli tak dotazováni ohledně jeho výcviku, instrukcích, jaké v armádě dostával a ohledně nože. U soudu bylo řečeno: „Tento nůž je dodáván jakožto expediční příbor. Musí být otevřen oběma rukama a nemá záklapku, takže jej lze uzavřít okamžitě.“

V předběžné přípravě na soud bylo zjištěno, že Josué nezpůsobil v armádě žádný problém ani se nedopustil špatného chování za celou dobu své služby v Čestném bataliónu Královského prastarého regimentu armády (Regimiento Inmemorial del Rez del Ejército de Tierra).

Jeho armádní kolega a spolubydlící, voják Ekvádorského původu, řekl, že podle něj Josué neměl rasistické smýšlení, ale připustil, že jejich vztah byl omezen jen na vojenskou základnu. Uvedl: „Nikdy jsem z něj nevycítil žádnou známku rasismu, byl to můj přítel. Byl dobrým společníkem a byl velmi tichý. Byl klidný povahou, velmi pacifický a měl dobré vztahy s imigranty v jeho oddílu. Jeho jediné zatčení proběhlo proto, že měl zmačkanou uniformu.“

V tento den se rovněž u soudu pouštěla většina záznamů z bezpečnostních kamer, včetně toho, kde Josué vytahuje nůž a kde bodl Carlose do hrudníku.

Obžaloba také přišla s fotkou, dodanou „antifašistickým monitoringem“ z Madridu, kde mimo jiné stojí mladý muž se zdviženou pravicí a tvrdila, že jde o obžalovaného před mnoha lety. Později vyšlo najevo, že jde o fotografii Bulharských chuligánů bez jakékoliv spojitosti s Josuém.

Osobní charakteristika Josuého použita u soudu:

Josué Estébanez má 25 let, narodil se a byl vychován v Galdacano, lokalitě převážně dělnické třídy, na okraji Bilbao, regionu Vasque na severu Španělska. V bytě žil se svojí matkou, babičkou a bratrem. Jeho otec, Bernardo, zemřel před deseti lety. V době incidentu žil Josué se svým bratrem v bytě ve městě Fuenlabrada v Madridském regionu. Jeho bratr musel posléze byt opustit, neboť byl zastrašován antifašisty.

Jeho matka Victoria je momentálně v Madridu kvůli soudu a zdá se, že o případu nemluvila s nikým z rodiny. Děda Josuého má 80 let a pamatuje si, že jeho vnuk pracoval jako elektrikář na nějaké konstrukci a myslel si, že tam pořád dělá. Josuého babička řekla: „Nic mi nedali vědět. Jediná věc, kterou vím, je, že jsem Josuého neviděla víc než rok.“

Rodina utajila fakt Josuého vstupu do armády ze stejného důvodu jako to bylo běžné v regionu Vasque – ze strachu ETA teroristických útoků a jejího politického křídla. Sousedé považovali rodinu za normální a slušnou. Pamatovali si, že otec před smrtí pracoval pro nějakou společnost. Syny neviděli po dlouhou dobu a jejich matka o nich údajně moc nemluvila. Sestřenice Victoria prohlásila: „Jsme normální rodina a nechceme vědět nic o téhle události, celá rodina je tím poznamenána.“

Záznam ze čtvrtého dne soudního líčení:

Raquel Muñoz, veřejná žalobkyně ve věci smrti Carlose Palomina, tento den zvýšila svůj požadavek na trest Josuého z 29 na 30 let. Zdůvodnila to tím, že by měl padnout maximální trest za tak závažný zločin s přitěžujícími okolnostmi ideologického motivu, převážně s ohledem na Josuého oblečení a jeho údajné výkřiky na antifašisty, a také kvůli pokusu o další zabití. Tvrdila za prokázané, že Josué jednal vůči Carlosovi na základě „ideologické diskriminace“ a za prokázané, že oblečení které na sobě měl je typickým oblečením pro neonacisty v Madridu. Dále znovu poukázala na jeho údajné hajlování a na to, že nazýval mladé antifašisty „guarros“ – „špinavé prasata“, což je typická nadávka, kterou používají pravicový extremisté na levicově smýšlející.

Žalobkyně také přinesla různé dokumenty, které byly později u soudu čteny a které obsahovaly petice na pomoc Josuému, organizované pravicově orientovanými skupinami. Poukázala přitom, že Josué je v nich vylíčen jako mučedník tohoto případu.

Státní zástupce odmítl jakékoliv argumenty a „výmluvy“ obhajoby a požadoval pro Josuého trest za vraždu: 20 let vězení a zákaz veřejné činnosti po stejnou dobu (za vraždu Carlose), jako přihoršující podmínky uvedl xenofobii. 9 let 11 měsíců a 29 dnů (?) za pokus o zabití. Za způsobená zranění 2 měsíce trestu a placení odškodného měsíčně po dobu 10-ti let. Zdůraznil fakt, že Josué „kontroloval situaci v každém momentu“ a že si připravil vražedný nástroj před tím, než skupina s Carlosem Palominem vstoupila do vagónu, ve kterém se zločin stal.

Soukromá obžaloba, která reprezentovala rodinu Carlose P, požadovala rozsudek ve výši 37 let za vraždu, pokus o zabití a nelegálního držení zbraně.

Další veřejná žaloba, reprezentující Hnutí proti intoleranci (Movimiento Contra la Intolerancia) požadovala stejný trest jako státní zástupce.

Obhajoba požádala o vězení ve výši 6 měsíců za zabití a 3 měsíce za způsobená zranění, operující s tím, že v případě zabití šlo o sebeobranu, kde bylo cílem vyhnout se vlastnímu (Josuého) ublížení na zdraví, či dokonce případné smrti a tím, že Josué jednal ve stavu velkého strachu. Obviněný v době soudu strávil 2 roky ve vazební věznici, tím pádem by po vynesení podobného rozsudku už dále do vězení nešel. Obhájce uvedl, že byl kompletně prokázán strach Josuého o vlastní život a že pokud by nenarazil na policejní hlídku, byl by ubit k smrti. O situaci v metru mluvil jako o situaci, kde Josué byl „obklíčen, zahnán do rohu a zastrašován“ a bránil jen svůj život. Dále řekl, že zločin byl ve skutečnosti neúmyslným zabitím, tedy něco, co jde dohromady s výpovědí obviněného.

Veřejná žalobkyně odmítla veškeré tyto argumenty a s ohledem na video, kde byl podle ní Josué velmi vzdálen od stavu „strachu o vlastní život“ a že video jasně ukazuje jeho přípravu zbraně a chladnokrevné vyčkávání u dveří bez jakékoliv známky pokusu o vyhnutí se konfliktu nebo útěku z místa. „Byli to ti ostatní, kdo měl strach,“ uvedla dále: „přestože je pravda, že byl obklíčen, nebyl to výsledek nějakého plánu obklíčení ale jen toho, že hodně lidí vstoupilo do vagónu a naplnilo jej.“

Ohledně stanoviska obhajoby o sebeobraně uvedla, že nelze aplikovat na daný případ, kde nebyla žádná známka předchozí agrese vůči obviněnému. Navíc uvedla, že ani není prokázáno, že by se Carlos dopustil nějaké verbální provokace, ale jen se Josuého zeptal na jeho oblečení. Její další slova byly: „Toto je jeden z vzácných případů, kdy máme záznam téměř celého incidentu, který se nám tak dostává do neobvyklé objektivity. Je to absolutní zobrazení fráze, že jeden obrázek má cenu tisíce slov.“

Další den budou u soudu pročítány a probírány posudky obžaloby. Soud skončí a bude se rozhodovat o trestu. Napřed však bude mít obžalovaný právo posledního slova, kde se hodlá omluvit rodině Carlose Palomina, jak to uvedl jeho právník.

Záznam z pátého dne soudního líčení:

Poslední den soudu byl určen ke konečnému úsudku nad případem a k poslednímu slovu obžalovaného. Obhájce požádal o zproštění viny, kde se odvolával na záznam z videa, kde lze vidět, že šlo o nesmyslné zabití, které však vzešlo ze strachu o vlastní život obviněného a z úmyslu sebeobrany. Během dvou hodin obhajoba popisovala situaci obviněného, který byl ve vagónu obklíčen a měl strach. Obhájce také odmítl navrhnutý trest veřejného žaloby žádající přitěžující okolnosti „ideologické diskriminace“, protože obviněný není a nebyl členem žádné pravicové strany nebo organizace, ale má „ideologicky neutrální názor“.

Dále ve své řeči popsal antifašistickou skupinu BAF, k níž Carlos náležel, jako „zločinecký gang“ a trval na tom, že tato skupina „nemá žádnou ideologii, stejně jako ji nemají neonacisté“. Zdůraznil fakt, že Josué „nezaútočil na lidi, kteří by zobrazovali své a jeho ideologické názory na nějakém politickém setkání nebo demonstraci“ a tudíž je podle jeho přesvědčení okolnost „politické diskriminace“ scestná. Zároveň se dotazoval ohledně důvěryhodnosti v utajené svědky, kteří podle něj mají „kmenovou sounáležitost“ s jejich zesnulým kamarádem.

Podle řeči obhájce jeho klient neměl v úmyslu vůbec zabíjet a nůž, který použil k bodnutí byl jen malý kapesní nůž, který armáda používá jako součást příboru a že tento nůž, je jen minimum z minima co si někdo může představit pod pojmem „ostrá zbraň“.

Mavi Muñoz, matka Carlose Palomina při odchodu ze soudu prohlásila, že závěrečná řeč Josuého právníka byla “ostudná” a že “je jasné, že Josué si zvolil právníka s blízkým vztahem k neonacismu”.

Nijak se však nezmínila, stejně jako nikdo jiný, o osobě právníka, zastupujícího veřejnou žalobu. Jeho jméno je Erlantz Ibarrondo, aktivní levicový antifašista, který v současnosti obhajuje 25 antifašistů obviněných z násilného výtržnictví, 7 antifašistů obviněných z útoku na policejní stanici a levicových chuligánů z Marsella, zatčených na jednom stadiónu. Byl také kandidát číslo 51 za politickou stranu Iniciativa Internacionalista v posledních volbách do evropského parlamentu. Tato strana je podporována teroristy z ETA a dalšími separatistickými organizacemi.

Obžaloba, se obklopila argumenty, které den před tím vynesl na světlo státní zástupce, že Josué spáchal vraždu ve jménu „ideologické nenávisti“ a že je plně prokázáno Josuého jednání z hlediska „sympatií k pravicovým ideám a zločin spáchal, neboť oběť měla opačné názory“.

Předseda soudu se Josuého zeptal, zda si chce vzít své právo na poslední slovo a on odpověděl, že ano.

Ve své řeči Josué uvedl: „Je mi líto, co jsem udělal. Nechtěl jsem vzít něčí život nebo někomu ublížit, ale měl jsem hrozný strach a nevěděl, co dělat. Netušil jsem, že to zajde tak daleko… …měl jsem svůj život, svou práci a všechno a najednou tohle. Je to situace, kdy nevíte jak se zachovat a já se za to velmi proviněný a je mi to líto, nechtěl jsem, aby se něco z toho stalo.“

Tímto soudní stání skončilo. Když osazenstvo opouštělo soudní síň, Carlosova matka zakřičela na Josuého: „Přeju ti všechno nejhorší v celém životě!“ a po odchodu řekla antifašistům, kteří ji obklopovali: „Nikdy mu neodpustím, přeju mu jen to nejhorší v tomhle životě.“

Rozsudek:

Josué Estébanez byl odsouzen k 26-ti letům vězení a shledán vinným z vraždy Carlose Palomina v Madridském metru. Za vraždu samotnou dostal Josué 19 let a 7 let za pokus o vraždu dalšího antifašisty.

Soud nazval motiv obžalovaného jako ideologickou nenávist, která vedla až k zabití jeho ideového oponenta.

Přestože Jousé po celou dobu soudu popíral, že by byl členem nebo sympatizantem nějakého neonacistického hnutí, soud se ztotožnil s obžalobou a označil zločin za ideologický. Své stanovisko vysvětlil v několika bodech:

- Jeho vzhled je typickým vzhledem neonacistického skinheada.

- Heslo „Sieg Heil“, které vykřikoval, když byl zatlačen do rohu po pobodání Carlose Palomina, se používalo za Třetí Říše.

- Dělal pozdravy zdvižením pravé ruky, což byla salutace SS (?)

- Vykřikoval nadávky jako „špinavé rudé svině, zabiju vás všechny“.

- Komentáře a aktivity extrémně pravicových skupin, které obhajovaly nebo se snažily zmírnit chování obžalovaného v dané situaci.

Navíc ke trestu vězení musí podle rozsudku Josué vyplatit rodině poškozeného 100.000 euro a dalších 500 euro antifašistovi, kterého rovněž pobodal.

Je očekáváno, že Josué se proti rozsudku odvolá.

LIBERTA 'E GIUSTIZIA PER JOSUE!

Molti di voi hanno sentito parlare del caso di Josué, il giovane militare Spagnolo che l'11-11-07 stava viaggiando nella metro e che fu circondato da un folto gruppo di militanti di sinistra in procinto di attaccare una manifestazione di un partito di estrema destra spagnolo . Josué ha difeso la propria vita contro la violenza del gruppo che era pronto ad attaccarlo e linciarlo. Il risultato è stato che nella collutazione uno della controparte è morto ed altri hanno riportato gravi lesioni. Nell'ottobre 2009 Josué è stato condannato a 26 anni di carcere: 19 anni per l'accoltellamento fatale di Carlos Palomino ed altri 7 anni per il tentato omicidio degli amici di Carlos P. che, nel frattempo, lo avevano aggredito.

Nella sentenza emessa dal Tribunale Regionale si è dato risalto all'odio ideologico che ha portato ad una sentenza più forte rispetto alla normativa vigente. Oltre al carcere a lungo termine, dovrà risarcire la famiglia della vittima con 100,000 € e 500 € ad uno degli accoltellati.

La famiglia di Josué fatto appello alla Corte Suprema spagnola per per ottenere l'assoluzione per l'autodifesa o eliminare almeno le aggravanti di "odio ideologico" , ma la Corte Suprema ha confermato la sentenza il 27/05/2010.

Alcuni mesi fa, lo hanno trasferito in un carcere nel sud della Spagna che si trova a circa 1.000 Km di distanza dalla sua famiglia e 500 km di distanza dai suoi amici più stretti di Madrid che lo ha visitato, per il solo fatto di rendergli la permanenza in carcere più difficile.

The judge considered the death of Carlos P. as a murder with perfidy (an intent wilfully to act in callous and wanton disregard of the consequences to human life) by this reasons:

The accused argues that Carlos P. asked him for the sweater and the money, saying immediately to this "bastard, I'll show you what's good" / ("bastard, You're going to be in a lot of trouble!"), but this is denied by all the witnesses, that were all protected witness as they were friends of Carlos P. or where in the same group of antifascists, that testified that Carlos P. only asked about the sweater as it had the legend "Three-Stroke”, a brand that is identified also by this antifascists witness as a brand used exclusively by neonazis. This garment could be worn by any person.” but this has not been considered. This brand sponsors black and mestizo jiu-jitsu fighters and there are photos of black fighters wearing Three Stroke t-shirts, so this seems a not very "neonazi" brand.

So with this arguments, the judge considers that Carlos P. knew that the accused was a person with an opposite ideology, and had no fear of a possible aggression due to the typical impulsivity of this adolescence and for the confidence that provided him to be surrounded by a big group of friends and antifascists like him. A proof of this is that he asked the accused about the sweater, being completely surprised by the suddenly stabbing, without any possibility of a defensive reaction, that was what the accused wanted when he hide the knife an moved next to the door, waiting to attack with any excuse to any of the persons he considered "antifascist" by his aesthetic. This is why it has been considered as a murder "with perfidy".

About this the accused declared that he wanted to go out of the wagon, so he went next to the door, but he was surrounded by the group of antifascists and the exit was blocked so he was not able to go out. He felt that they were going to attack him and that he would not escape alive from there. He stabbed him because he was frightened, not because it was an antifascist or by hate. Then he tried to move away the attackers and escape as soon as he had an opportunity

Attempt of homicide of a friend of Carlos p. sentence, and the fact of the weapons:

The court in the sentence says that there were weapons carried by the antifascists, but they do not considered that is proved that were carried by the people in the same wagon as the accused. It is also said that this group had a violent attitude, as they attacked the legal demonstration with baseball beats, flares, and even molotov cocktails but this it is considered as subsequent events.

The accused says that a hooded person throw CS gas in the wagon, what blind him, and for this reason he had to go to the opposite side of the train. In this moment entered two person that said "we are going to kill you" for this reason he showed the knife to avoid them go get near him.
One of the protected witness said that he tried to disarm the accused with a plastic piece that it is used to cover the fire extinguishers, remembering only that when he entered in the wagon was a hard smell to pepper spray, but his eyes were adapted sooner to this, and he went to the end of the wagon, where the accused was, and had a struggle with him, without noticing he had been stabbed till he left the wagon and saw his blood.

This is confirmed by a woman that was a security guard, that saw the accused grabbing the a guy by the neck, and she pulled the guy to free him and get him out of the wagon. Just at that moment a girl in the platform sprinkled the security guard face with a CS gas spray, whose objective was the accused, but as she was in the middle she received the gas.

According to the court, the fact that one of the antifascist showed a knife in a later moment, specifically when a security guard tried to help Carlos P., as related by this security guard: ("one of the antifascist hit me with the elbow in the jaw. Therefore, in spite that it has been proved that there was a group of around 100 antifascists in the underground with the purpose of disrupting violently a legal demonstration and that the antifascists had, at least, a CS gas spray, a knife, a brass knuckle that could be see in the video, and later they used baseball bats, flares and molotov cocktails the judges have believed the declarations of the antifascists ("we did not have weapons, we were only carrying whistles") and not the declaration of Josué, that says that he saw weapons and he was verbally threatened, and for this reason they have denied to apply the excuse of self-defence, state of necessity to avoid an evil/worst harm (his own death) and insuperable fear asked by the defence.

The aggravating circumstance of ideological hate:

The judge had considered that is proved that the accused was going to a demonstration of the far right party Democracia Nacional, as the next station of the underground was near the place where started the demonstration, and as it was around 12:00 when all this happened, the same hour when the demonstration was expected to start. Other "proof" of this is that Josué was carrying a knife as there was a possibility of clashes with antifascist demonstrators, and that he had a aesthetic of neonazi skin. Josué says that he we was going to have a lunch in the house of two friends, whose names he does not want to say to avoid problems for them. The judges have not believed this. Josué said also that the knife he carried was a official knife of the army he have bought, and that he took it out of the base because he had to go to manoeuvre next day

The judges said that the extreme right ideology of the accused is fully proved by this facts:

a) His aesthetic of neonazi skin.

b) The motto 'Sieg Heil', of german origin that could be traduced as : Heil victory, that was frequently used in the political meetings in Germany during the III Reich, and was shouted by the accused after stabbing Carlos P. (part of this phrase was litearally copied from Wikipedia, http://es.wikipedia.org/wiki/Sieg_Heil . It seems that is the new source for laws for the Spanish judges...) Josue said that he doesn’t know the meaning of the expression 'Sieg heil' and that he never shouted that.

c) The salute of the forces of that time, known as SS, that consisted in extending the arm and the hand to till the level of the shoulder, with the arm and the hand to the front. This was only declared by the antifascists, that said that heard this from inside the train, even with a glass behind and with all the noise from the rest of the travellers in the platform. A security guard said that she did not saw any salute neither heard any shout of this kind while she was inside the train. A video recording saw a gesture partially compatible with this salute, and Josué in his declaration denied making a nazi salute inside the wagon when he was alone inside. ("I rise my arm to told him to leave") Apart from this, this supposed salute could be considered as the fascist salute or the national socialist salute, but in no case the "salute of the SS".

d) The word "guarros" (filthy pig) used in different moments to make reference to the antifascists. According to the antifascists witness and the police "expert" that is how the right-wingers call the left-wingers.

e) The comments and actions defending or trying to mitigate the behaviour of the accused made after the incidents by far right groups, as reflected in the documents showed by the private accusation. About this, Josué had no possibility of controlling what happened outside the prison, and he can not avoid that some people expressed his sympathies for him.

In the sentence it is said that this conclusion about the ideology of the accused it is not distorted by the good relation and without racist attitudes that he had with his south American working mates in the army, as related by the Ecuadorian witness that was a soldier in the same base as the accused, because they only talked about thing related to the job and not about political ideas. Josué declared that he was not a neonazi. He also said that he doesn’t hate the antifascist neither is against the immigrants "How can I hate an immigrant if I have immigrant friends and I shared my room in the army base with an immigrant?" The judges have not believed this.

The extreme ideological differences in the way of thinking was the motive of the aggression of the accused against Carlos P. as it is reflected in the attitude of the accused of hiding the knife and moving next to the door. According to the judges Josué wanted to attack any of the antifascist at the first opportunity and without any excuse as he hated them. This is denied by the accused in his declaration “I saw punks and skinheads in the platform. The pointed at me saying 'go and catch them' and shouted kill threats. I felt scared, so I pulled out the official knife of the army I was carrying in my trousers. They entered in the wagon and I was cornered by these persons that were carrying weapons. They said to me "you are not going out of here, fucking fascist". They had a knife and a brass knuckle, and they threatened again to kill me several times. One of them pointed at me and other pulled out a brass knuckle. Other entered in the wagon making his way among the rest. He blocked my way and asked for my sweater and my money. My instinct went out. I felt that they were going to attack me and that I would not escape alive from there. I stab him because I was frightened. Then I tried to move away the attackers and escape as soon as I have an opportunity. "

About the regrets expressed by the accused when he made use of his right to give his last words before the end of the trial, the judges had not considered this as a extenuating circumstance, as: it was said in the last moment, during all the trial he have had an impassive attitude, and for his despise to the persons of opposite ideology that was the triggering factor leading up to the murder.

The sentence:

19 years of prison for the murder of Carlos Palomino

7 years of prison for the attempted murder of one of the friends of Carlos P. that attacked Josué.

500 € penalty to pay to one of the antifascists stabbed

92.257,01 € penalty for the mother of Carlos P, and 67.096,00 € for the father

The court has approved the insolvency declaration of the accused as actually he has no patrimony or income.

How has received the sentence Josué?
We have talked before knowing the sentence and he was very calm. He was waiting for the sentence without nerves. It is the first time in Spain that the aggravating circumstance of ideological hate has been considered.
The judges have made a partial interpretation of the facts. They have only considered the declarations of the friends of Carlos P. which we consider tendentious.

Had Josue the aim of killing?
We do not think that the murder was with perfidy. Josué get loose of Carlos P. and do not want to have anything more to do with him, he did not make certain of the death. The video images that benefit my client have not been shown.

Current situation of Josué

Given the recent developments related to Josué, we have decided to update the blog, in order to have a place to tell people about his current situation, reflecting information provided directly by him and his family.

After the publication of the sentence that convicted Josué to twenty-six years of prison with the aggravating factor of ideological hate, which had never been applied before in Spain (even in the case of terrorists and murderers like De Juana Chaos), an appeal was submitted to the Supreme Court, that upheld the ruling of the Provincial Court of Madrid.

Despite this, a new resource has been submitted to the Constitutional Court, and it won’t stop until we get justice for Josué, being willing even to take his case to the Strasbourg Court if necessary.

As if the disproportionate conviction imposed to Josué were not enough, are continuous the irregularities that Josué is undergoing, some of which we list below.

- Josué has been included in the FIES regime (a restrictive regime imposed to terrorists and traffickers), with the restrictions that it entails.

- He also was moved without previous notice to a prison in Cádiz, even further away from his family.

- Requisitioning of academic books, so he can not study in prison (although studies are usually promoted among the prisoners).

- Seizure of clothing, music and magazines, as well as the letters sent by his loved ones.

- Denial of integration activities (as the assistance to the library or the gym, and the exits to the prison yard).

- Denial of visits, etc.

From this humble corner of the web, we will keep fighting for justice for Josué, because SELF DEFENCE IS NOT A CRIME.

Nowadays, our priority is the impending move of Josué to a prison near his home, in order to facilitate the visits of his family.

26 years for Josue Estebanez, found guilty of Madrid underground murder

The court considered ideological hate motivated the killing of an anti-fascist protestor

The soldier on trial for the murder of a young anti-fascist demonstrator at a Madrid metro station two years ago has been sentenced to 26 years in prison: 19 years for the fatal stabbing of Carlos Palomino and another 7 years for the attempted murder one of the friend who came to his aid attacking Josue.

While the accused, Josué Estébanez, denied that he was a neo-Nazi during his trial, the provincial court in Madrid considered, as the prosecutor had argued in the case, that ideological hate was behind his motives for the stabbing, giving him a lengthier sentence for the murder.

The reasons to consider this are:

a) His aesthetic of neonazi skin

b) The motto 'Sieg Heil', he shouted while he was cornered after stabbing Carlos Palomino, used during the III Reich

c) For making the salute with the arm up, the salute of the SS ¿?

d) For shouting: "Dirty red scum I am going to kill you all"

e) The comments and actions of far right groups defending or trying to mitigate the behaviour of the accused.

In addition to the lengthy prison term, he must now pay the victim’s family 100.000 € compensation and 500 € to one of the antifascists stabbed.

It is expected that the family of Josué will appeal against the sentence.

5rd day Josue trial

Today was the 5th and last day of the trial against Josué Estebanez, it was the time for the conclusions of the parts and the last words of the accused.
The defence of the accused has plead for the free acquittal, considering that the stabbing of Carlos P. as it could be seen in the video recordings was an unwise homicide with the excuse of self-defence and insuperable fear. During two hours the defence has reiterated the version of his defendant, who said that when the antifascist entered in the wagon he was "surrounded" and "had fear". He has also refuted the petition of the public prosecutor of pleading for the aggravating circumstance of "ideological discrimination", because the accused is not militant or activist in any party or political organization of the far right but he has a "neutral ideological personality"
The defence lawyer has described the antifascist group to which Carlos P. belonged (the BAF - Anti Fascist Brigades) as a "criminal gang" , and has stated that these groups "do not have ideology, as well as the nazis neither have it". He has insisted in the fact that Josué "did not attacked people that were making a public display of his ideology, in a political meeting or in a assembly", so in his opinion this aggravating circumstance has no place at all. In the same line he has questioned the trustworthiness of the protected witness in the trial, as he consider that they have a "tribal affinity" with the deceased.
He has stated that his client has no aim of killing at all, and has said also that the knife used was a small pocket-knife as the one used in the army to eat as a expedition piece of cutlery, and that it was in the "minimum of the minimum" of the blade weapons, only maybe above of a nail clipper.
Mavi Muñoz, the mother of Carlos P. has said at the exit of the court that the speech of the defence has been "shameful" and said that "it is clear that Josué has had a defendant with ideas very close to neonazism" Well, it seems that hearing some truths hearts. Perhaps she could also talk about the ideas of the defendant of the private prosecution: Erlantz Ibarrondo, a leftist antifascist militant. He is the lawyer that defence 25 antifascist accused of violent riots, of 7 antifascist accused of assaulting a police station, of the leftist hoolligan of Marsella arrested in a Spanish stadium, and he was also the 51th candidate in the list of the party “Iniciativa Internacionalista” (Internationalist Initiative) for the last European elections, a party that is supported by the ETA terrorists and by all the background that support the vasque separatists and the terrorists.
The particular accusation and the private accusation have embraced the arguments exposed yesterday by the public prosecutor, and have remarked the appropriateness of imposing the aggravating circumstance of "ideological hate", as they think that is proved that the accused had "sympathies with the far right ideas and he committed the crime because the victim had opposite ideas"
Yesterday the president of the Tribunal asked Josué if he wanted to make use of his right to give his last words afters the end of the trial, and Josué said "Yes"
In his speech Josue said "I fell sorry for what I did. Of course I did not wanted to take anybody’s life or harm anybody, but I was very frightened and I did not know how to react. I did not know this was going to go that far'". "I had my life, my work, I had all, but... in a moment, in this circumstances you do not know how you are going to react, and I am very sorry, I did not wanted do anything of that."
With this the trial ended and it is pending of sentence. It is expected that the sentence will be passed in 15 years, although with the Spanish justice you never know, as there are some persons judged by "illegal organization" that since march 2009 are still waiting for a sentence of the court.
When the public was going out of the court, Mavi Muñoz shouted "I wish you the worst of this life" and in the exit, surrounded by the antifascist demonstrators she also said "I am not going to forgive him. I wish him the worst of the worst in this life"
We wish all the best for Josué and we wish that he would get the free acquittal, or the minimum sentence possible.

Σήμερα πραγματοποιήθηκε η δευτέρη συνεδρίαση της δίκης του Josue,με την ακρόαση των αυτοπτών μαρτύρων. Οι περισσότεροι από αυτούς ήταν φίλοι του Carlos Palomino ή άλλοι αντιφά που βρίσκονταν εκείνη τη στιγμή στο τραίνο,οπότε ήταν ξεκάθαρο το τι περιμέναμε από τις καταθέσεις τους. Συνολικά υπάρχουν 17 μάρτυρες εκ των οποίων οι 10 είναι υπό προστασία.Οι φίλοι του Carlos κατέθεσαν ότι μαχαιρώθηκε "χωρίς να υπάρξει κάποια λογομαχία" και πως ο Carlos δεν είχε καθόλου περιθώριο να αντιδράσει καθώς εξεπλάγει από την επίθεση του Josue, που τον μαχαίρωσε στο στήθος,με αποτέλεσμα τον θάνατο του μετά από λίγα λεπτά."Δεν είχε κανένα περιθώριο να αντιδράσει. Ρώτησα έναν από αυτούς που πήγαιναν και μου απάντησε σε ένα ματς της Getafe FC».Ένας τρίτος σεκιουριτάς δήλωσε ότι όταν προσπάθησε να βοηθήσει τον Palomino που «αιμορραγούσε και τρίκλιζε», ένας αντιφασίστας τον χτύπησε με τον αγκώνα στο σαγόνι, και ο σεκιουριτάς νόμισε ότι είδε τη λάμψη από ένα αιχμηρό όπλο, αν και είπε ότι δεν νομίζει ότι ήθελαν να τον βλάψουν γιατί μετά από λίγο έκαναν χώρο ώστε να βοηθήσει το θύμα. «Αν ήθελαν να με δείρουν, θα το είχαν κάνει. Νομίζω ότι ήταν αμυντικής φύσης η σκέψη τους, γιατί θεώρησαν ότι θα τους επιτεθώ».Εκτός από ότι συνέβη στο δικαστήριο, σήμερα το πρωί σε διάφορες πόλεις της Ισπανίας, το νερό σε κάποια σιντριβάνια είχε βαφτεί κόκκινο. 4rd day Josue trial

Raquel Muñoz, the public prosecutor in the trial of the death of Carlos P. has increased today his petition of sentence from 29 years to 30 years, as she consider that the maximum sentence should be imposed for the crime of murder with the aggravating circumstance of ideological motivation due to his clothing and the expressions he shouted, and for the crime of attempt of homicide. She considers that is proved that Josué acted against Carlos P. by "ideological discrimination". As she told this is proved by the clothing he was wearing "typical of the neonazis of Madrid", because he made the fascist salute, and because he called the youths "guarros" (filthy pig) that is how the right-wingers call the left-wingers. The public prosecutor has made also reference to various documents that have been read in the court by petition of the private prosecution that collect signs of support for Josué from groups of the far right, pointing that "he is considerer a martyr of his cause".
The public prosecutor deny all the arguments / excuses of the defense, and plead "For the crime of murder: 20 years of prison and prohibition from holding any public office during the same time, with the aggravating circumstance of xenophobia ; for the crime of attempt of homicide: 9 years, 11 months and 29 years of prison ; for the crime of injuries: 2 months of penalty with a monthly fee of 10 years." The public prosecutor emphasized the fact that Josue Estebanez "controlled the situation in every moment" as he prepared and hide the homicide weapon before the group of Carlos P. entered in the wagon where the crimes were committed.

The private prosecution that represents the family of Carlos P. maintained their petition of 37 years of prison for murder, attempt of homicide, threatens and illicit possession of weapons. The public prosecution, represented by the Non Governmental Organization "Movimiento Contra la Intolerancia" (Movement Against Intolerance) plead for the same sentence that the public prosecutor
The defense plead for 6 months of prison for homicide and 3 months for severe injuries, considering in the first crime the defences / excuse of self-defense, state of necessity to avoid an evil/worst harm (his own death) and insuperable fear. The accused has passed nearly two years in preventive prison, so if this is the sentence he would not serve this time. The defense lawyer said that it has been completely proved that his client was in risk of death if he had not found the two policemen that protected him from receiving a death beating from the friends of Carlos P. He was "surrounded, cornered and threatened" and he acted to "defend his life". He said that the crime was in fact a "negligent homicide", something that goes in the line of the statement of the accused.
The public prosecution has denied this excuses, as she said that the attitude of Josue that could be seen in the video recordings was "incompatible with a fear state", as in the video it could be seen that he prepared the weapon, he places himself in front of the door and do not ask for help neither tried to escape. "The rest is who had fear" and said that "although is true that he end surrounded, this was not a result of an intention of surround him, but for the huge number of people that was in the wagon". About the excuse of self-defense she said that it is not applicable as there was no previous aggression, although it is not proved that there was a provocation by Carlos P. who only tells him something about the sweater he was wearing"
"This is one of the rare trials where we have images of most of the events, what gives to it an unusual objectivity. Here take sense the phrase "One image worth for 1.000 words"
Tomorrow will finish the reports of the prosecutors. The trial will end and will be pending of sentence after the last words of the accused, how might apologize to the family of Carlos P. as his lawyer said.
In any case according to the Spanish laws the maximum time that Josué will have to serve is 20 years, and he has already served almost 2 years, one of them in a military prison.

3rd day Josue trial

Today was the 3rd session of the trial, with 9 witnesses: the two local police agents that arrested Josue, a police inspector of the Information Brigade specialized in "urban tribes", and the security chief oh the underground. Other witness are an Ecuadorian soldier colleague of Josue in the army, and four high ranks of the Army: a colonel, a lieutenant colonel, a lieutenant and a brigade. This four were called by the accusation to clarify, among other things, if the knife was provided by the army.

The chief of the XXI of the National police, specialized in urban tribes and ideology extremists and with 12 years of experience, has declared as "legal expert". He said after seeing the images of the accused the day of the incident that "this is a neonazi skin". This was based in the fact that he as wearing a sweater of the brand “three stroke” and by his physical appearance, as he had the head shaved. He said in various occasions that is possible to identify the ideology of the extremist by his esthetic. (The only
thing is that the soldiers in the Spanish army used to have the hair shaved, like the skinheads, and wear military clothing or the official trouser of the army that has the Spanish flag on his sides)

The defense lawyer gave to the "expert policeman" some images of the three-stroke website. The judge said "Do you mean this paper that says spring - summer collection?". The police expert" said then that the sweater, by it self, did not need to be considered as peculiar of neonazis. “This garment could be worn by any person” said the policeman. The defense lawyer said then, “Please notice that these clothes could be worn by anybody. It could be sell in a department store" to play down the importance of the declaration of the policeman.

The importance that this sweater is having in the trial is so, that according to the press it seems that If Josue has not wore that sweater that day nothing would have happened.

Version 1 is of Carlos Palomino's friends. "We entered in the wagon and we were al shocked by seeing this guy with this sweater, a sweater that only the neonazis wear. We were so shocked that no one said anything, we were speechless. Only Carlos dare to ask him about the sweater, and he was stabbed without crossing any word. Carlos only asked. "And this sweater?", he did not have time to say anything more." Other friend said. "Carlos touched his chest and asked him about the sweater", nothing more.

Version 2 is of the alleged homicidal "He pushed me in the chest or in the stomach, I do not rember well, and he told me "give me the sweater and all that you have" This his his version, he was punched by Carlos P. and he tried to rob him, what united to the threats supposedly said by the antifascists, and the brass knuckle and the knife supposedly brandish by the left wingers, could justify the defenses/argument of self-defense".

The three went behind the car and they were surrounded by the crowd "that started to hit us". They tried to reject the aggression with their truncheons. The accused was behind the policemen, and did not tried to defend himself. "We can avoid receiving some pushing’s, punches, and wounds" according to the police statement that was made later. They did not arrest or took the data of anyone due to their aggressive attitude. The accused was wounded as he received some kicks and punch in the eyes. He had the risk of being killed by a beating. They called an ambulance and the accused was sent to the Saint Charles Clinic Hospital. They search him and found a brass knuckle in the right pocket of his track trouser. The defense said that Josue took it and keep it while he was being beaten. One of the popular accusations used this fact to accuse him of "possession of illegal weapon"

One of the policemen said that Josue was "very calm" when he was arrested.

The declaration of the four high ranks of the army did not make much contribution, as all said that they did not know personally the accused. They were asked about the military instruction of the accused and about the knife “This knife is given as a expedition piece of cutlery. It has to be open with both hands and has no fastener, so it could be closed in a moment.”

Before the trial in the preliminary investigation, it was found that the accused had not caused any problem neither had bad behavior in the year he had been serving in the "batallón de honores del Regimiento Inmemorial del Rey del Ejército de Tierra" (Honour battallion of the King's Immemorial Regiment of the Army)

His room mate in the army, a soldier of Ecuadorian origin. Said that Josue did not seem racist in his opinion, but that his relation was only limited to the army base. "I have never sawn any sign of racism in any moment. He was my friend. He keep me company. He was very quiet" . "He was a quiet persons, pacific and with a good relation with the immigrants in his unit". "He was never involved in a violent incident". He's only arrest was for having the uniform wrinkled.

In this session most of the CCTV recordings of the underground have been shown, in one of them it could bee seen how the accused pulled out the knife and stab Carlos P. in the chest.

The accusation has shown also a photo, provided by the "antifascist coordinating committee" of Madrid where a young man can be shown with his right arm raised, which is supposed to be a photo of the accused years ago. It has been discovered that this is not josue in the photo, but that is a photo of Bulgarian hooligans without any relation with Josue.

With this finish the first week of the trial against Josue.

More CCTV recordings will be shown in the 4th session of the trial, and analyzed by legal experts. It is also expected to have the first conclusions of the trial.

Josué Estébanez of 25 years old, was born and risen in Galdacano, a working class locality in the outskirts of Bilbao, in the Vasque region in the north of Spain. There in a block lives his mother, his grandparent and his brother. His father, Bernardo, died 10 years ago. His brother at the time of the incident lived with Josue in a flat in Fuenlabrada, a city in the Madrid region, but he had to flee as he was threatened by the leftwingers.

His mother Victoria, is in Madrid for the trial, and seems that has not talked about the crime with anybody of his family. The grandfather of Josue, in his 80's, remembered that Josue had worked as electrician in some constructions, and he thought that this was still his job. "I have not seen him since some years ago. I know that he has been in Almeria and in Madrid, working in his profession". The grandmother said that "They do not told me anything. The only thing I know is that I have not seen my grandson since a year ago". The family has concealed he fact that Josue had join the army, something common in the Vasque region due to the threats of the ETA terrorist and his political branch. The neighbourhoods remember his family as normal and discreet. They remember that before dying, the father was employed in a company. "The sons have not been seen here since long time ago, and she didn't talked too much about them" A cousin of Victoria, said "We are a normal family and we do not want to know a thing about this event. All the family is affected"

2nd day Josue Trial

Today was the second season of the trial, with the declaration of some witness of the incident in the underground. Most of them were friends of Carlos Palomino or antifascist that were in the train, so It was clear what can be expected from their declarations. There are 17 witness, 10 of them are "protected witness".
The friends of Carlos said that he was stabbed "without crossing words" and that Carlos has no time to react as he was surprised by the attack of Josue, who stab him in the chest and as a result of this died some minutes after
"He has no time to react. Josue rush towards him directly and stab him" told one of the witness, friend of Carlos Palomino. This witness explained that Josue threatened all the persons that tried to disarm him with the words "I am going to kill you all, shitty red scum (guarros de mierda)" and at the same time he shouted 'Sieg heil' with his arm up, like the nazi salute.
Other witness said that Josue hide the knife behind his back, moments before the antifascists entered in the wagon. This circumstance of the preparation of the weapon is a relevant fact why the public prosecutor is accusing Josue of assassination and not of homicide, what implies that the sentence could be higher. "He was in a corner with the knife ready, hide behind his back. Carlos approached and said "Hey, this sweater?" - of the supposed neonazi brand three stroke (not very neonazi as they sponsor black and mestizo jiu-jitsu fighters)- The guy stab him directly after that. "All was very fast. We started to say that he was carrying a sharp weapon. When we finally realized, Carlos have been already stabbed. One of the antifascist girls told that when she saw the knife tried to alert Carlos Palomino, but when I shouted the guy had the knife in the air."
The first 7 witness identified the sweater Josue was carrying as the ones used by the nazis in Madrid. Other friends of Carlos said that Josue shouted "Come, Come on, I am going to kill you all". Other saw Carlos in the platform, after the aggression, and he told me "They have stabbed me" Other told that Carlos fail to the ground after walking 30 meters"
One underground sub inspector told that apart from the knife the accused was carrying, he din not saw any other weapon, and that the people that were in the platform was people that was not causing a breach of the peace or of the order. Other witness was a security guard, that arrived after the incident, that told that the accused did not ask for help to go out of there, and that he saw other of the guys stabbed "I saw a guy with blood in the hands and in the clothes and I was scared"
All the antifascist witness told that they had no weapons, they were only carrying whistles to silence the "racist consigns" that were going to be shouted in the demonstration of Democracia Nacional. The lawyer of the defense asked to the witness if they saw any of the youngsters carrying "weapons, brass knuckles, sticks or baseball bats" to what they replied "No".
This question upset the family of the victim. They were also upset when the defense lawyer insisted in asking if a group of 50 antifascists surrounded the door of the wagon where Josue was, to give credibility in this way to the version of the accused, that said that he stabbed Palomino because "he was scared" of being surrounded by persons with weapons shouting to him.
The security guards that helped the victim told that before the aggression there was no alteration in the underground station. "They were not carrying flags neither sticks. They were walking correctly, talking among them. I asked one of them where they were going and he told me that to a football match of Getafe FC"
Other security guard, the one that tries to clam the situation inside the wagon in the video told that "My idea was to try, as far as I could, to avoid that anybody come close to him". She said that the people shouted her "Catch him! catch him!" but he couldn't. She was scared. After this she lost conscience because someone sprinkle her face with CS Gas. The next day we took a sick leave as she discovered that was 1 month and a half pregnant.
A third security guard told that when he tried to help Carlos Palomino, who was "bleeding and staggering", one of the antifascist hit him with the elbow in the jaw. He also told that he saw a sharp weapon different from the one Josue was carrying. "It was a metallic blade, I saw the shine of a sharp weapon and they tried to stab me". I could not identify the aggressor and 30 seconds after this they make space so that I could help the victim". "If they had wanted to beat me they would have done it. I think that it was in defense thinking that I was going to attack them"

Apart from what happened in the court, this morning In different cities of Spain some water fonts have appeared with the water dyed in red, a vandalism action of the antifascist to remember Carlos Palomino. 50 antifascists were present in the exit of the court during the morning.

Today has started the trial against Josué Estébanez accused of the assassination of the antifascist Carlos Palomino, and attempt of assassination of a friend of Carlos Palomino. The public prosecutor request 17 years of prison for the first aggression and 12 years for the second.
The accusation request 37 years of prison: 20 years of prison for assassination, 10 and attempt of assassination, 4 for threatens and 3 for illicit possession of weapons. The popular accusation also request the aggravating circumstance of 'ideology-political motivation'
The trial will last till the 24th of September, from 9:00 to 12:00 in the mornings. The first week will be for the interrogation and declaration of Josue and 17 witness, 10 of them protected witness. The Friday will declare some superiors and workmates of Josue in the army, where he was serving when the incident in the underground happened.
The second week will be for the declarations of 6 legal experts and will be shown the images recorded by the CCTV cameras of the underground. Last two days will be dedicated to the conclusions.
In his declaration the accused said: "I saw punks and skinheads in the platform. The pointed at me saying 'go and catch them' and shouted kill threats. I felt scared, so I pulled out the official knife of the army I was carrying in my trousers. They entered in the wagon and I was cornered by these persons that were carrying weapons. They said to me "you are not going out of here, fucking fascist". They had a knife and a brass knuckle, and they threatened again to kill me several times. One of them pointed at me and other pulled out a brass knuckle. Other entered in the wagon making his way among the rest. He blocked my way and asked for my sweater and my money. My instinct went out. I felt that they were going to attack me and that I would not escape alive from there. I stab him because I was frightened. Then I tried to move away the attackers and escape as soon as I have an opportunity. I run away from the underground and this people tried to catch me. I found a local police patrol and asked for help, but this people caught me and beat me."
Josué said that he was carrying the army knife because the next day he was going on manoeuvre with his unit in the army, and that we was not going to the demonstration of Democracia Nacional in Usera, but to have a lunch with some friends in the neighbourhood of Villaverde.
He also said that he doesn’t knows if the 'Three Stroke' sweater he was carrying was a "symbol of extreme right" as it was a present from a friend that practise kickboxing.
When the prosecution asked if he was a neonazi he said that he was not. When he was asked if he was a patriot he said, that "I am just a Spanish. A person that is happy when the national team wins a match". The lawyer of the popular accusation of "Movimiento contra la Intolerancia" (Movement against Intolerance) asked if he loved the Spanish state of Franco of the Spanish state of the Democracy, and Josue said "¿How can I love the Franco state if I am too young to have known it. How can i love something I am unaware of?Josue said that he doesn’t know the meaning of the expression 'Sieg heil' and that he never shouted that.He also said that he doesn’t hate the antifascist neither is against the immigrants "How can I hate an immigrant if I have immigrant friends and I share my cell in the prison with one immigrant?"
Part of the statement of Josue- When he was asked if the considered that the antifascists were not patriots he said "As I have never talked with one of those, I do not know... The ones I know do not believe in the nations"- About the question of if he had received military instruction he said "I was specialized in military parades. I was not trained in the use of sharp weapons"- He said that the knife he carried was the official knife of the army, and that he took it out of the base because he had to go to maneuver next day. He used it to cut ropes and peel fruit.- He denied making a nazi salute inside the wagon when he was alone inside. I rise my arm to told him to leave.
The accused denied several times to be member of any association or political party, or having prejudices against the immigration.
His lawyer, Enrique Martin, valued positively that the trial left apart the politic. "We are in a court and we have to play with the instruments of the law". In his opinion, "a group of persons might have mistaken Josue by his appearance, thinking that he was going to the demonstration".
The accused keep eye contact with almost all the persons that speak to him. He replayed without hesitation to the seven lawyers one after another.
After the declaration of Josue has briefly declared the mother of Josue, Victoria Muñoz. She told that she gave permission to his son to go to the counterdemonstration against the neonazis, and that the only thing he told him before leaving was "Take care, there could be problems"
Victoria Muñoz told that she knew where was his son going, "to a counter demonstration against a group that rejects the immigrants" In that line, said that his son, that was of "antifascist ideology", did not use to go to demonstrations, but in that occasion he went to accompany some friends.
Some friends of the victim that were in the wagon also declared. They said that Carlos Palomino only said to Josue "Hey, man" surprised to see a sweater used by neonazis. He also said that after stabbing Carlos Palomino Josué was constantly shouting "Sieg Heil" and "I am going to kill you red scum"
In the entry of the court there was a meeting of antifascist with banners saying "Carlos, brother, we don't forget" and "Your assassination will not go unpunished"
At the end of the season two nationalist skingirls appeared throwing handmade leaflets that among other thing reclaimed "Freedom for Josue, nobody should jail the air between bars". On brave antifascist has punched one of the girls, that was helped by the police.
No organized concentration was held by nationalist groups, because this could only be bad for Josué, who does not want a political trial, but a fair trial.

2007 november 11-én egy hitvány szélsőbalos csürhe érkezett a madridi Legapzi metróállomás peronjára. Céljuk egyértelmű volt: megtámadni valakit, akit spanyol hazafinak tartanak, mivel ugyanakkor, onnan nem messze a spanyol kormányzati szervek által is legálisnak elismert spanyol nemzeti párt tartott megemlékezést. A szélsőbalos és anfifasiszta csoportnak csak az járt a fejében, hogy megrohanja a gyűlést és megtámadjon minél több embert.
Ennyi volt csupán a céljuk.
Mialatt az erőszakos, garázda tömeg elfoglalta a peront, az egyik vagonban már ott volt Josué, egy fiatalember, aki megjelenését provokációnak tartották az erőszakos szélsőbalosok. Josué azonnal felismerte, hogy komoly életveszélyben van (a peron tele volt a áldozat után kutató szélsőbalosokkal). Ő egyedül volt, míg a peronon több mint 50 –en voltak. Eldöntötte, hogy megvédi életét. Az ajtók kinyíltak, és a vagonba beözönlött ez a hitvány tömeg. A bátor, szélsőséges hősök azonnal kiszúrták Josuét és készen álltak megtámadni, és meglincselni (a fősodratú média által közzétett CCTV – videón a 39. másodpercben lehet látni, hogy az ajtóval szemben álló bátor antifa előhúz egy boxert, míg a többiek csak röhögnek, és tőröket szegeznek neki a kinézete miatt). Josué – noha készen állt arra, hogy megvédje az életét – megpróbálta elhagyni a helyszínt, amikor az összes szélsőséges beszállt a vagonba. Az egyikük azonban, Carlos Javier Palomino karjával elzárta a kijáratot, és a ruhájáról kezdte kérdezgetni.
Mindegyikünk tudja, mi történt volna ezután: mindegyikünk tudja, hogy nem a nemzetközi szocialista virtusról vagy a bankok államosításáról kezdtek volna eszmecserébe. Ezután egy hatalmas ütés következett volna, egy boxerrel az állkapcsára, vagy a bordájára, esetleg egy szúrás. Ez az igazság. Josué eldöntötte, hogy megóvja az életét.
Nem számít, hogy Josuénak volt-e valamilyen ideológiája vagy sem. Hogy szerette-e a futballt, vagy a bikaviadalt. Josué csak utazott a metrón nyugodtan, egyedül. Aztán hirtelen körbevette 50 erőszakos szélsőbalos, akiknek egyetlen céljuk az volt, hogy leszámoljanak a „fasizmussal”.
Kérlek terjeszd az igazságot ezzel a történettel kapcsolatban. Ne hagyd, hogy manipulálják az események leírását, hogy Josué tárgyalását a fősodratú média befolyásolja, és a madridi álszent szélsőbalosok, akiknek nincsenek ismerősei a te ismerőseid között. Ők egy ember életével játszanak, olyanéval, aki azt tette, amit bárki más is tett volna a helyében: megvédte a saját életét.

11.listopadu 2007 vešel do stanice metra Legazpi v Madridu dav extrémně levicových aktivisů. Měli jasné úmylsy – napadnout každého, koho by považovali za “španělského patriota”, jelikož ve stejnou dobu a nedaleko od místa se konalo shromáždění organizované nacionalistickou Španělskou stranou. Toto shromáždění bylo legální a povolené místními úřady. Levicoví aktivisté chtěli shromáždění narušit a útočit na tolik lidí, kolik by se přihodilo. To byl jejich jediný účel.
V tu chvíli přijel do stanice metra vlak, v němž byl Josué Estebanez. Člověk, jehož vzhled mohl okamžitě sloužit pro provokaci z řad levicových extremistů, kteří mezitím zaplnili celou stanici. Josue měl na sobě mikinu značky “three stroke”, která je mezi nacionalisty ve Španělsku velmi rozšířená a sportovní kalhoty se španělskou trikolórou – to byl jeho přestupek. Josué okamžitě rozpoznal nebezpečí, ve kterém se ocitl. Zatímco on byl uvnitř vagónu sám, na stanici bylo kolem 50 agresivních antifašistů hledajících svoji oběť. Rozhodl se bránit svůj život a své zdraví – připravil si nůž na svoji obranu a čekal. (Kritiky jeho akce je poukazováno, že mohl vlak opustit, ale všichni mohou vidět, že metro bylo zaplněno levičáky a také – proč by měl člověk, který se ničeho nedopustil utíkat? )
Dveře se otevřely a vagón se začal zaplňovat mladými agresivními antifašisty. Okamžitě si všimli Josuého a seskupovali se kolem něj, čekající na někoho, kdo by konflikt začal. Na videu z průmyslové kamery, která se rozšířila v médiích, můžete na čase 00.39 vidět jednoho levičáka, jak si nasazuje boxer, další se na Josuého jen pochechtávají. Z videa lze také usoudit, že Josué se chystal metro opustit, ale možná viděl, že situace by byla stejná. Ona situace, která eskalovala, když dovnitř vstoupil Carlos Javier Palomino a okamžitě strčil do Josuého s poukazem na jeho oblečení.
Všichni racionálně uvažující lidé ví, co se bude v takové situaci dít dále. Víme, že Carlos by nezačal s Josuém probírat témata jako ctnosti mezinárodního socialismu nebo znárodňování bank. Ne. My víme, že dalším krokem po obyčejném šťouchnutí je rána pěstí nebo boxerem, kopance do žeber, když člověk leží na zemi a nebo dokonce rána nožem. A Josué nechtěl skončit v nemocnici v kómatu. Josué nechtěl být další obětí levicové lůzy, jako jí byl Eduardo Garcia Gelber, kterého levičáci zabili před několika lety v Barceloně za podobných okolností. Ne, Josué se rozhodl bránit svůj život! Bodl Carlose nožem a posléze se bránil útokům dalších antifašistů. Za tento krok si vysloužil obvinění z vraždy a z Carlose se stal “nevinný mučedník zabitý zlým neonacistou”!
Je absolutně nedůležité pro tuto situaci, zda Josué byl zastáncem nějaké ideologie nebo ne. Jestli měl rád fotbal nebo býčí zápasy. Josué prostě normálně cestoval metrem – SÁM. A byl napaden padesáti antifašisty, kteří měli ono ráno jen jeden cíl – čelit “fašismu” násilím.
Prosíme, šiřte pravdu o tomto případu. Nenechme, aby se lidé dozvídali jen překroucené informace z masmédií a pokrytecký popis událostí, jak jej podávají Madridští levicoví extremisté. Nenechme aby se takhle překroucený popis událostí dostal mezi naše známé – kolegy v práci, kamarády, rodinu, ...
Systém si teď pohrává s životem muže, který jen udělal to, co by každý správný člověk udělal na jeho místě: BRÁNIL SVŮJ ŽIVOT.
SPRAVEDLNOST PRO JOSUÉHO! SVOBODU PRO JOSUÉHO! OBRANA VLASTNÍHO ŽIVOTA NENÍ ZLOČIN!!!

23-х летний Йосе Эстабанес (Josué Estebánez) совсем недавно был приговорён к 29 годам тюремного заключения. Причиной такого длительного срока стала самозащита Йосе от нападения толпы анархистов (антифашистов) численностью в около ста человек.На станции метро Легаспи на Йосэ Эстэбанеса напала группа анархистов. Как указывается в газетах, причиной нападения была кофта молодого человека якобы выпущенная фирмой, которую любят носить в патриотических кругах. Так или иначе, на видеозаписи сделанной камерами в метро чётко видно, что иного выхода у Йосэфа не было, кроме как защищаться всеми возможными средствами. Если бы он не стал себя защищать, то стадо антифашистов просто растоптали бы его. И никто из этой сотни человек не получил бы серьёзного срока. Это известный факт, и такое происходит достаточно часто, примеров предостаточно.Единственным выходом сохранить себе жизнь против невменяемой толпы была жёсткая самозащита. После того, как антифашисты не смогли напасть на патриота в электричке, они бросили в вагон слезоточивый факел. Йосэф успел выскочить из вагона и спасся бегством.Несмотря на неоспоримое доказательство видеозаписи, где видно кто начал, и что у Йосэ Эстабанеса не было другого варианта, его приговорили к такому длительному сроку (который вполне может оказаться и пожизненным). Иначе как судебной расправой над испанским народом это назвать нельзя.Я призываю всех не забывать этого человека, поддерживать его и писать ему (на английском или испанском языке). Le 11 Novembre 2007, une foule compacte de militants d’extrême gauche arrivèrent dans la station de métro de Legazpi, à Madrid (Espagne).Leur intentions étaient claires : attaquer quiconque qui serait suspecté d’être un « patriote Espagnol ». Il avaient en effet appris la tenue d’un meeting organisé par un parti nationaliste Espagnol non loin de là, connu et autorisé par les autorités gouvernementales. La seule chose que les membres du groupe d’extrême gauche antifasciste avaient en tête était d’empêcher le meeting nationaliste et d’attaquer le plus de personnes concernées possible. Telles étaient leurs intentions. Lorsque que cette foule arriva sur les bords de la station de métro, cherchant à déclencher une violente émeute, une rame de métro arriva. A son bord se trouvait Josué, un jeune homme dont le look pouvait être pris comme une provocation par les nervis d’extrêmes gauche. Josué se rendu compte immédiatement du risque qu’il courait. (Une station de métro pleine d’antifascistes cherchant une victime.) Il était seul et sur les bords de la station de métro, ils étaient plus de 50. Il se résolu à protéger sa vie. Les portes s’ouvrirent et la rame de métro se remplit de cette misérable foule. Ils remarquèrent immédiatement Josué et étaient prêt à l’attaquer et le lyncher ! (Sur la vidéo de surveillance du métro, on peut voir à la 39ème seconde, un des extrémistes de gauche situé devant la porte s’armer d’un poing américain, les autres riant et regardant Josué de travers par rapport à son look.) Josué bloqué, bien que prêt à défendre sa vie, essaya de sortir de la rame de métro quand tout le groupe d’extrême gauche entra. Mais l’un d’eux, Carlos Javier Palomino, bloqua la porte de sortie de son bras et commença à demander à Josué pourquoi il avait ce look. Nous savons tous comment se termine ce genre d’histoire. Tout le monde sait qu’il ne va pas s’engager une discussion sur les vertus du socialisme international ou de la nationalisation des banques. Non. nous savons tous que la prochaine étape est un tabassage en règle, un poing américain te ravageant la figure, tes cotes...Etc. C’est la vérité. Vapaus Josuelle – suomalaisille lukijoille
11. marraskuuta 2007 joukko äärivasemmistolaisia astui sisään Legazpin juna-asemalle, Madridissa. Heillä oli selkeä tavoite: hyökätä kaikkien vähääkään ”Espanjalaisilta patriooteilta” vaikuttavien kimppuun, koska samaan aikaan oli Espanjan nationalistinen puolue pitänyt lailla turvatun kokoontumisen lähettyvillä. W listopadzie 2007 roku około 50 lewackich ekstremistów próbowało zaatakować narodowego aktywiste Josue Estebanez de la Hija na stacji kolejowej w Madrycie.Duża grupa "antyfaszystów" wsiadła do pociągu, ktorym samotnie podróżował Josue.Miał na sobie bluze firmy Three Stroke co sprowkowało agresorów, niektórzy ściągali już pasy by "rozprawić się z faszystą"."Antyfaszyści" polowali na samotnie wracających z legalnego wiecu hiszpańskiej partii narodowo-demokratycznej.Po zamieszkach w okolicach wiecu "antyfaszyści" udali się na stacje kolejową, tam w jednym z pociągów spotkali Josue.Postanowił on nie być kolejną ofiara, postanowił bronić własnego życia.Sam przeciwko kilkudziesięciu lewackim bojowkarzom.Josue, 24 letni żołnierz, próbował wydostać się z pociągu lecz drzwi zastawił jeden z "antyfaszystów", Carlos Javier Palomino wypytując go o jego ubranie.Jasnym jest jak kończą się takie spotkania, zwłaszcza gdy "antyfaszyści" są w dużej grupie naprzeciwko pojedynczego osobnika.Rozmowa zwykle nie trwa długo, Josue postanowił nie podzielić losu zabitego przez "antyfaszystów" kilka lat wcześniej w Barcelonie Eduardo Garcia Gelbera, który zginął w podobnych okolicznościach.Otoczony przez agresywnych ekstremistów chłopak nie miał innego wyjścia jak obrona.Aby wydostać się z opresji zaatakował bojówkarza, który zastawił drzwi w wyniku czego "antyfaszysta" stracił życie.Udało mu się uciec, banda rzuciła się za nim w pogoń.Hiszpańskie media rozpoczęły nagonke na Josue, na każdym kroku podkreślając jego "neonazistowskie" poglądy, próbując uczynić z nich motyw działania choć Josue stanął przed wyborem: bronić się lub dać się zabić.Sam przeciwko 50 agresywnym anarchistom.Josue został uwięziony i oskarżony o morderstwo, choć zapis monitoringu z pociągu, skwapliwie pomijany przez hiszpańskie media, nie pozostawia złudzeń: Josue bronił się przed agresywną bandą!Hiszpańskie środowiska patriotyczne prowadzą kampanie na rzecz uwolnienia Josue i przedstawienia prawdziwej wersji zdarzeń, zniekształconej przez główne media.Kampania odbywa się pod hasłem "Obrona własnego życia nie jest zbrodnią".

Имали су јасне намере: да нападну сваког закога су мислили да је "Шпански патриота", јер се истовремено недалекоодатле, одржавао скуп Шпанске националистичке партије, одобрен илегализован од стране Шпанске владе. Припадницима екстремне левице иантифашистима је једино било на уму да нападну скуп и повреде што вишељуди.Док је руља чекала метро и припремала се за нереде, у једном од вагонаје био Josue, младић чији је изглед очигледно провоцирао екстремнелевичаре и анархисте. Josue је одмах схватио да му је живот угрожен(перон пун екстремних левичара и анархиста који траже жртву). Он јебио сам, а напољу се налазило више од 50 људи. Био је решен да заштитисвој живот. Врата су се отворила и вагон се напунио овом одвратномруљом. Они су га одмах приметили и припремили се да га нападну (увагону се налазила CCTV камера која је снимила овај догађај, у 39.секунди може се видети један левичар испред врата како вади боксер,остали су се само смејали и гледали мрко у њега). Josue је био спреманда заштити свој живот, покушао је да напусти вагон, али су левичари ианархисти већ ушли у њега. Један од њих, Carlos Javier Palomino јеблокирао врата својом руком и почео да га испитује о његовој одећи.Многи од нас знају шта би се следеће догодило, знамо да они нећерасправљати о врлинама интернационалног социјализма илинационализацији банака. "11 листопада 2007 року радикальне ліве угрупування антифашистів зайшло на станцію метро Legazpi в Мадриді. Вони мали чіткі наміри: нападати на будь-кого, кого б запідозрили в тому, що він «іспанський патріот», так як саме в цей час, недалеку відбувалася акція організована націоналістичною партією Іспанії. Акція була легальною і санкціонованою. Члени ж екстремістського лівого угрупування, котрі зібралися в метро, мали на меті лише одне – атакувати згадану акцію та завдати ушкоджень якомога більшій кількості людей. Це були їхні наміри.Коли натовп вже готувався на платформі метро розпочати насильницький рейд, в одному з вагонів метро, що проїжджало перед натовпом виявився Хошуа, чий зовнішній вигляд міг спровокувати насильство з боку лівих радикалів. Він відразу усвідомив серйозний ризик для свого життя, адже платформа була повна небезпечних лівих радикалів та антифашистів, котрі якраз шукали собі жертв. Хошуа був один, а ззовні вагону - більше ніж 50 агресивно налаштованих осіб. Він вирішив захищати своє життя.Відчинились двері й вагон переповнився агресивним натовпом. Покидьки відразу ж помітили Хошуа та приготувалися до нападу(на відеозаписі з камер спостереження, що був розповсюджений ЗМІ ми чітко бачимо, що на 39 секунді, один з антифашистів розташований перед дверима і одягнений в червоні штани тримає в руці кастет; решта з натовпу відверто агресивно сміялась оточивши Хошуа). Хошуа, що прагнув зберегти своє життя, мав намір покинути вагон, коли ліво радикали заходили у потяг. Але один з них, Карлос Хав’єр Паломіно, коли Хошуа вже посувався до виходу заблокував двері вагону своєю рукою. Після цього Хав’єр, що входить до угрупування червоних скінхедів і не раз брав участь у жорстоких вуличних бійках, вчепився за реглан Хошуа і прискіпався щодо його одягу.Ми всі розуміємо, що б сталося далі. Ми всі знаємо, що ліваки не мали на меті дискутувати з приводу Соціалістичного Інтернаціоналу, чи націоналізації банків. Не мали! Але ми розуміємо, що наступним кроком стало б тяжке побиття Хошуа, його б вдарили кастетом по щелепі, чи ребрах, а ймовірно – підрізали. Це правда. І Хошуа прийняв рішення не дати відправити себе в реанімацію. Він вирішив, що не стане жертвою, як Едуардо Гарсія Гельбер, що був убитий кілька років тому в Барселоні лівими екстремістами за подібних обставин. Ні, натомість Хошуа вирішив захищати своє життя. Неважливо, чи Хошуа діяв внаслідок якоїсь ідеології, чи ні. Чи він любив футбол, чи кориду. Хошуа спокійно пересувався метро. ОДИН. І раптово опинився серед 50 агресивних антифашистів, що мали на меті одне того дня: зустріти «фашизм» насильством.Просимо поширювати правду! Не дайте маніпулювати інформацією! Версія мас-медіа, що була створена лівими силами набула поширення і необхідно допомогти людям дізнатися правду! Вони жонглюють з долею хлопця, що зробив те, що мала б зробити будь-яка нормальна людина за тих обставин: ЗАХИЩАТИ СВОЄ ЖИТТЯ. СПРАВЕДЛИВОСТІ ДЛЯ ХОШУА! СВОБОДУ ХОШУА! Am 11. November begaben sich viele Linksradikale in die U-Bahnstation Madrid-Legazpi. Ihre Absichten waren klar definiert. Alle, die Sie als spanische Patrioten ausgemacht hatten, anzugreifen. Unweit von der Haltestelle sollte eine nationale Demonstration stattfinden welche von der spanischen Regierung genehmigt wurde. Veranstalter sollte eine nationalistische Partei Spaniens sein.
Die Linksfaschichsten der ANTIFA/AUTONOME wollten mit aller Macht die Kundegbung der Nationalisten stören und laut eigener Aussage “kaputt machen”! Dafür war ihnen jedes Mittel recht und Sie griffen sämtliche Leute an, von welchen Sie dachten, dass Sie patriotische Bürger seien.
Zur selben Zeit als die AUTONOMEN HORDEN im U-Bahnschacht waren und strafbare, gewalttätige Handlungen gegen die Demonstration planten, fuhr eine Metro ein, in der im ersten Wagen sich ein patriotischer Junge Namens JOSUE befand. Die kommunistischen und verbrecherischen Banden hatten JOSUE aufgrund seiner Kleider sofort als spanischen Patrioten ausgemacht, da THREE STROKE eine beliebte Marke unter nationalen Jugendlichen in Spanien ist.
JOSUE ahnte von Anfang an die bedrohliche Gefahr für sein Leben (eine ganze Metro-Station voller gewaltbereiter Antifaschisten die nur nach einem Opfer suchten, welches Ziel ihrer blinden Aggressionen werden sollte). Er war ganz auf sich allein gestellt, und da traf er für sich die Entscheidung, sein Leben mit allen verfügbaren Mitteln zu verteidigen.
Die Türen der Metro öffneten sich und der Wagon war binnen weniger Sekunden voller Antifaschisten! Ehe noch die Türen sich schlossen, erkannten Sie JOSUE und fingen an Ihn zu provozieren und herumzuschupsen. (in einem Video der Sicherheitskräfte der U-Bahn, welches man auch in www.Youtube.com sehen kann, ist klar zu erkennen wie ein Roter Jugendlicher einen Schlagring in seiner Hand hält und die anderen Autonomen sich über JOSUE aufgrund seiner Kleidung und patriotischen Einstellung lustig machen. Dies kann man im Video an der Stelle 0:39 deutlich sehen!
Obwohl JOSUE vorbereitet war um sich zu Verteidigen, wollte er raus aus dem Wagon, jedoch gelang Ihm dies nicht. Da zuvor alle Mitglieder der kommunistischen Gruppen und der extremen Linken in den Wagen strömten und Ihm der Weg durch Carlos Javier Palomino´s Arm versperrt wurde.
Viele wissen, was nun passieren würde und jeder weiß auch dass jetzt keine politische Diskussion beginnen würde über den internationalen Sozialismus usw.
Viele wissen, dass der nächste Schritt eine monumentale Schlägerei ist, die damit endet das man einen gebrochenen Kiefer, verursacht durch einen Schlagring, hat oder eben einige Messerstiche im eigenen Leib spürt.
JOSUE entschied das er nicht ein weiterer Fall, wie der von EDUARDO GARCIA GELBER, der in einer ähnlichen Situation von EXTREMEN ANTIFASCHISTISCHEN GRUPPEN ermordet wurde, sein würde - NEIN JOSUE ENTSCHIED SICH ZU LEBEN!
Es ist egal welcher politischen Fraktion JOSUE angehörte, ob er Fussballfan war oder auch nicht. JOSUE war ALLEIN, GESITTET und mit FRIEDLICHER ABSICHT mit der U-Bahn unterwegs! Und er wurde von 50 antifaschistischen DÄMONEN bedrängt die nach seinem Leben getrachtet hatten! Sie sind allein mit dem Ziel „CHAOS UND UNRUHE ZU STIFTEN“ nach Madrid angereist und nicht wie Sie beteuern eine Gegendemonstration abzuhalten. Ihr einziges Ziel war es GEWALT UND TERROR GEGEN ANDERSDENKENDE, in dem Fall spanische Patrioten, ZU SÄHT!
Bitte verbreitet die Wahrheit über diesen Fall, damit der Systempresse, antifaschistischen Kreisen und sonstigen Lügenheuchlern die Grundlage entzogen wird, „ihre Wahrheit“ über den Fall in dem Bewusstsein der Bevölkerung und auch in deinem Freundeskreis zu etablieren bzw. manipulieren.
Die ANTIFASCHISTEN haben mit einem Leben gespielt und es gezielt angegriffen. JOSUE tat nur das was jeder Spanier und auch jeder Mensch anderer Herkunft in dieser oder einer ähnlichen Situation getan hätte:

On November the 11th 2007 a despicable extreme left-wing crowd entered the Legazpi tube station platform, in Madrid. They had clear intentions: to assault everyone suspicious of being “Spanish patriots” since at the same time, not far from there, it was held a meeting organized by a nationalist Spanish party allowed and legalized by the Government Sub-delegate’s Office. The members of the extreme left-wing and antifascist group only had in mind to storm the said meeting and attack the more people the better. Those were their intentions.
While this crowd took up the tube platforms heading to start violent riots, into one of the coaches it was Josue, a young man whose look could be taken as a provocation by the violent extreme left-wingers. Josue noticed immediately the serious risk for his life (a platform full of extreme left-wingers and antifascists looking for a victim). He was alone and outside the coach there were more than 50 people. He resolved to protect his life.
The doors opened and the coach was getting full of this despicable crowd. These misfits immediately detected Josue and were ready to attack and lynch him (in a tube CCTV video widespread by mass media you can see, on second 39, one of the extreme left-wingers located in front of the door drawing a brass knuckle; the rest were just laughing and looking daggers at him due to his look). Josue, in spite of he was ready to protect his life, tried to leave the place when all the extreme left-wing group got into the coach. But one of them, Carlos Javier Palomino, blocked the exit door with his arm and started to ask about Josue’s clothes.
Many of us know what’s happen next; many people know they’re not going to discuss about the International Socialism virtues or the nationalization of the banks. No. Many of us know the next step is a huge beating, a brass knuckle beating your jaw or your ribs and even a stab. That’s the truth. And Josue resolved he was not going to let them lead him to the hospital and go into a coma; Josue decided he was not going to be another victim, just like Eduardo Garcia Gelber, killed some years ago in Barcelona by an extreme left-wing group under similar circumstances. No, Josue resolved to protect his life.
It doesn’t matter if Josue was into a certain kind of ideology or not. If he liked football or bullfighting. Josue was quietly travelling by tube, ALONE. And he was harassed by 50 enraged antifascists who had only one motivation that morning: to face “fascism” violently.

L'11 Novembre 2007 un ignobile gruppo di estrema sinistra fece ingresso nella stazione metro' di Legazpi a Madrid con chiare intenzioni: assalire chiunque fosse considerato uno "spagnolo patriotico". Infatti non poco distante da li' si teneva una dimostrazione organizzata dal Partito Nazionalista Spagnolo e legalmente autorizzata dalle autorita' del Governo.
L'intento di questo gruppo di antifascisti era quello di fare irruzione a questa dimostrazione ed attaccare piu' persone possibili.
Mentre il gruppo di facinorosi si apprestava ad occupare il marciapiede e ad attuare il loro piano, in una delle carrozze della metro' che stava sopraggiungendo si trovava Josue, il cui look fu subito individuato dagli estremisti come un possibile bersaglio. Josue immediatamente capi' che la sua vita era a serio repentaglio, trovandosi peraltro da solo e con piu' di 50 persone pronte a tutto. Decise cosi' di prendere tutte le dovute precauzioni del caso per proteggere la propria vita.
Non appena le porte della carrozza si aprirono gli estremisti presero possesso della carozza ed immediatamente individuarono Josue come loro vittima e si preparavano ad entrare in azione (in un video a circuito chiuso della metro' successivamente distribuito dai vari media, e' possibile vedere al 39'' come uno dei gli estremisti davanti alla porta si stia preparando ad assalire Josue con un tirapugni mentre il resto del gruppo ride e fissa Josue con disprezzo). Josue, malgrado fosse deciso a difendere la propria vita, cerco' di lasciare la carrozza mentre gli estremisti stavano per entrare in treno. Ciononostante, uno di loro Carlos Javier Palomino blocco' la porta con un braccio ed inizio' a a deridere Josue per i suoi vestiti.
Molti di noi sanno cosa e' successo subito dopo; molta gente sa che il loro intento non era quello di discutere delle virtu' dell'Internazionalizzazione del Socialismo o sulla nazionalizzazione delle banche. No. Niente di tutto questo, molti di noi sanno che quel che stava per succedere e' un pestaggio, con tanto di tirapugni nella mandibola o nelle costole e pure una coltellata. Questa e' la verita'. E Josue' decise di non essere la vittima di turno, come successe qualche anno fa a Eduardo Garcia Gelber, assassinato a Barcellona da un gruppo di estrema sinistra in simile circostanze. No, Josue' decise di proteggere la propria vita.
Non importa l'ideologia politica di Josue', se gli piaceva il calcio o la corrida. Josue' stava tranquillamente viaggiando in treno ed era SOLO. E fu infastidito da 50 antifascisti invasati e con un solo intento quella mattina: "dare una lezione ai fascisti".
Per favore diffondi la verita', non lasciare che l'informazione manipoli la verita', che i mass media mettano Josue' alla gogna e che l'iopcrisia mostrata dall'estrema sinistra madrilena abbia diffusione tra il tuo gruppo di amici, conoscenti e familiari. Stanno giocando con la vita di un uomo che ha semplicemente fatto cio' che ogni persona di buonsenso avrebbe fatto: PROTEGGERE LA PROPRIA VITA.
